Corona's 'incomplete' SALNs violate charter?

MANILA, Philippines - Prosecutors want to present evidence regarding the wealth of Supreme Court Chief Justice Renato Corona because they want to point out that he failed to complete his statements of assets, liabilities and net worth (SALNs) properly, which violates the law, a legal expert said Thursday.

"How can disclosure be said to have been complied with if it is only half?" said lawyer Vicky Avena, a University of the Philippines law professor.

"Kalahati ng katotohanan ay hindi katotohanan," she added.

"My interpretation is what Sen. [Alan Peter] Cayetano pointed out -- the allegations, the ultimate facts in [Article 2, section] 2.2, 2.3 [of the impeachment complaint] already sufficiently imply violation of the constitution happened in several ways," said Avena, a former Presidential Commission on Good Government official.

"Iyung non-completion (of SALN), iyun ang gustong puntuhin ng prosekyusyon," she said. "Mayroon pa palang ibang property, hindi mo dineklare."

Corona's lawyers, who opposed the presentation of pieces of evidence regarding Corona's alleged undeclared and ill-gotten wealth, are accusing prosecutors of going on a "fishing expedition."

"This is no longer about SALN but on ill-gotten wealth," said lead defense counsel Serafin Cuevas.

The prosecution, however, is insisting that the pieces of evidence they want to present will show if Corona's entries on his SALN are correct.

Rep. Miro Quimbo, the prosecution spokesman, also said Article 2 of the impeachment complaint clearly states that ill-gotten wealth is among accusations against Corona.

Avena also explained her views on the issue.

"Mayroon kang ill-gotten wealth, bakit ill-gotten ang sinasabi?" she asked. "Ill-gotten in the sense na kapag hindi mo sinasabi, hindi mo dineklare sa SALN iyan, mayroong ill-gotten, kasi public official ka. Iyun ang pinupunto."

"Magkadikit iyan, iyung presumption na iyon at iyung requirement sa SALN," Avena said.

The documents show that his net worth went up from P14.9 million in 2002 to P22.9 million in 2010. Former President Gloria Macapagal Arroyo appointed him to the Supreme Court in 2002. She named him chief justice in 2010.

2002 showed a 14 million worth of assets without any liabilities, 2004 showed with 18 million of assets with a libility of 11 million and a net worth of 7 million, saan napunta iyong cash na 11 million na tinanggap ni CJ? Iyong total assets ni CJ shold be 25 million, di ba? Kapag tumanggap ka ng cash, dapat kasama ito sa assets, di po ba?

"underdeclaration" with intent to defraud the government of duties and taxies.

while the SALN may appear to be in order having listed undervalued properties, presumably based on low assessed valuation, it still excludes other properties admittedly owned by the holy crown.

by omitting to declare other properties, the SLAN therefore is an underdeclaration which involved dishonesty and fraudlent intent. it is worse than killing a person.

all that the prosecution needs to prove is that the holy crown owns several properties outside of his SALN.

Really o ayaw lang nilang lumabas ang tutoo kaya dinadaan na lang sa technicalities. Hard evidences ang lumalabas, TCTs, sa susunod ITRs and Bank Accounts. Hindi magisinungaling ang documents di tulad ng mga sanay na sinungaling dyan na gagawin ang lahat para ituwid ang mali. Yun ba ang sukatan ng magaling na lawyers kapag acquit ang guilty? Kung alam nilang walang mapapatunayan ang prosecutors de hayaan nilang maipakita yung mga evidences at yun ang pagbasehan natin, hindi yung di pa man eh, I object na kagad!

As the senate hearing on the CJ's impeachment progress, people were witness as to how a half-baked articles of impeachment and an ill-prepared 11-man prosecution team from the prostituted house can make up a complete recipe for disaster.

article 2 of the impeachment filed by prostituted congress alleges corona from non-filing of his SALN. there was no allegation of irregularity or acquisition of ill gotten wealth. as basic rule in an impeachment case, sen / judge escudero said that there can only be one accusation in one article of impeachment. this is in contrary to what the prosecution panel wanted to happen. basically, what they want is to add 2 more accusations to article 2 of the impeachment case they filed when in fact article two only alleges the non-filing of CJ's SALN.

if the prosecution panel will have their way, they want article two expanded to insinuated other charges without certified true copies of titles and properties in so far as CJ's SALN is concerned. prosecution also failed to present people who can certify under oath relevant documents and yet having the nerve to expose such unverified documents to public. cuevas constantly reiterated the importance of statements that will constitute ultimate facts which the accuser must have personal knowledge. the register of deeds doesn't have have personal knowledge about those transactions which only proves that the prosecution really doesn't have a good case to prove in the eyes of a competent court.

If the non-filing of SALN would be the only basis for article two, it is clear that corona will be acquitted since corona's SALN are readily available in the offices of SC and would you believe, even in malacanan.

What the prosecution is after is the disclosure of Corona's assets and liabilities.
And when you look at the evidence and documents presented by the prosecution it is very clear that Corona is hiding something.


"Incomplete"

With the addition of Drillon, Pangilinan and ABS-CBN resources/reporters to the prosecution team, how can Corona possibly expect fair treatment or for that matter, a fair trial. 99% of ABS-CBN reporting is leaning against Corona. Drillon and Pangilinan might as well shed their "judge" robes and sit with the prosecution team because all they do is assist the prosecutors who are obviously ill-equipped to go against the defense panel. Even if Corona's SALN is complete, the media will surely find a way to condition the public's mind that he is guilty even if the prosecution has yet to prove its case. Where is the journalistic ethics and sense of fair play?


In other words

Therefore the defense is on a fishing expedition for fishing expeditions. How would they know if the prosecution is on an expedition unless they are already fishing?

ever wonder why the HLI (aquino-cojuangco family) did not appeal (yet) the decision of the supreme court to distribute the hacienda luisita? it is because they are counting on noynoy and his prostituted allies in congress to railroad the impeachment of the chief justice. the real intention is to pressure the CJ to resign so they can use mr. mambabraso in sc to reverse the ruling of sc in luisita.

if noynoy is fortunate to remove corona from sc, the task would be easier. however, nonoy and his prostituted allies in congress did not expect that their original plan to pressure corona to resign will fizzlle out. now that the original plan has gone kaput, the amatuers need to prove their case or else they need to start wearing some mask.
