Former Ampatuan lawyer charged with tax evasion
MANILA, Philippines (UPDATE) - A former lawyer of Zaldy Ampatuan was charged with tax evasion before the Department of Justice (DOJ) on Thursday.
Atty. Redemberto R. Villanueva was charged for an alleged total tax liability amounting to P36.93 million for alleged deliberate failure to supply correct and accurate information in his Income Tax Returns (ITR) for 2010 and 2011.
BIR Commissioner Kim Henares bared that the bureau conducted a preliminary investigation on the respondent and discovered that Villanueva allegedly incurred expenditures amounting to P59.12 million in 2010 and P10.39 million in 2011.
The complaint alleged that his acquisitions in 2010 included a piece of land in Dasmarinas Village, Makati worth P58.47 million, and a parking space at Eisenhower Condominium in San Juan City valued at P0.55 million. Based on his ITR for 2010, he allegedly only paid income tax amounting to P110,788.
For 2011, Villanueva allegedly purchased an Eastwood Lafayette property amounting to P2.62 million and an Eisenhower Condominium in San Juan City valued at P2.56 million. Based on his ITR, he incurred expenses amounting to P5.38 million but paid an income tax amounting to only P3,743.20, according to the BIR investigation.
Using the Expenditures Method of Investigation, Villanueva's alleged underdeclared income in 2010 and 2011 amounted to P58.46 million and P4.9 million, respectively.
Last November, another Ampatuan lawyer, Atty. Arnel Cortez, was also charged for tax evasion for an alleged total income tax liability amounting to P27.56 million.
The case against Villanueva is the 141st filed under the BIR's Run After Tax Evaders (RATE) program under the Aquino administration.
Villanueva has yet to receive a copy of the BIR complaint.
