BPI, PSBank to comply with impeach court summons
MANILA, Philippines - Two banks, where Chief Justice Renato Corona allegedly kept several accounts, said they will comply with the subpoenas sent by the Senate impeachment court.
In separate statements, Ayala-led Bank of the Philippine Islands (BPI) and Metrobank unit Philippine Savings Bank (PSBank) said they will appear before the trial and testify on Corona's reported bank accounts.
"BPI has received the subpoena and our bank representative will attend the hearing as directed," said Rita Canchela of BPI Corporate Communications.
PSBank president Pascual Garcia III also said: "We received the subpoena in connection with the impeachment trial and we shall appear in the hearing."
The subjects of the subpoenas were PSBank branch along Katipunan Avenue in Quezon City and BPI along Ayala Avenu in Makati City. Bank officials have been required to present statements showing the balances of Corona's accounts from 2005 to 2010.
Prosecutors from the House of Representatives earlier listed five accounts supposedly owned by Corona with the two banks. One of the accounts is a dollar account said to be containing $700,000 as initial deposit.
They said Corona failed to disclose these in his statements of assets, liabilities and net worth, an offense they specified in Article 2 of the impeachment complaint.
Earlier, senator-judges were uncertain whether or not to subpoena the bank accounts as this might violate confidentiality issues under at least one law governing bank records -- Republic Act 6426 or the Foreign Currency Deposits Act.
Section 8 of RA 6426 reads: "All foreign currency deposits authorized under this Act are hereby declared as and considered of an absolutely confidential nature and, except upon the written permission of the depositor, in no instance shall foreign currency deposits be examined, inquired or looked into by any person, government official, bureau or office whether judicial or administrative or legislative, or any other entity whether public or private."
Another law, Republic Act 1405 or the Bank Secrecy Law, also states that all deposits with Philippine banks are "absolutely confidential" and may not be examined by any person or government official. However, it cited exemptions such as "upon written permission of the depositor, or in cases of impeachment, or upon order of a competent court in cases of bribery or dereliction of duty of public officials, or in cases where the money deposited or invested is the subject matter of the litigation."
The Bangko Sentral ng Pilipinas has said that complying with legislative summons was in the discretion of the banks.

Leal is in great danger of being cited in contempt after the latter was caught between his lies during the investigation of the senate committee on banks.
during the hearing, leal was too evasive with the inquiries asked by senate president enrile intended to ferret out the truth. JPE is almost convinced that Leal was the source of the leaked bank document but is refusing to tell the truth forcing JPE to cite leal in contempt.

leal during the investigation admitted that he asked for the screen shots of the accounts of chief justice corona. Garcia narrated that they provided documents to the BSP through jerry leal for compliance to the remaining queries made pertaining to the the 112 accounts in Nov. 24. this statement was corroborated by Co, who told sen. lacson that she was present when these documents were turned over.
during the investigation, it was proven that leal sent an email sometime around 8:40 a.m. on the 24th, and on around 2 p.m. of the 25th, at PS bank head office. the compliance officer had submitted the said documents upon his request.
obvious proof that there is a preparation for a conspired defense, BSP came up with four affidavits of leal. it is really hard when you get caught between your lies.
even if JPE crush leal's balls, he wouldn't dare tell the truth because this shenanigan will point to the balding man in the palace.
