Amid controversy, PSBank reports bond sale demand

MANILA, Philippines - Philippine Savings Bank, in the news for rebuffing impeachment court demands for Chief Justice Renato Corona's alleged dollar accounts, said it sold P3 billion of bonds and that there was P6 billion of demand for them.

In an e-mailed statement, PSBank, a unit of Metropolitan Bank and Trust Co., said it sold the bonds at a yield of 5.75 percent. It said it would use the funds to boost lending.

ING Bank was the lead arranger of the bond sale. Multinational Investment Bancorp., First Metro Investment Corp. and PSBank helped sell the securities. 

PSBank last year bought back P2 billion of 10-year bonds five years before they were due saying it was more beneficial to do so amid falling interest rates, having sold them with an interest rate of 10 percent in 2006.

PSBank President Pascual Garcia last week refused to disclose information about Corona's alleged dollar accounts to the Senate, where the chief justice is on trial after being impeached by the House of Representatives.

He cited secrecy provisions in the 1974 Foreign Currency Deposit Unit (FCDU) law.

Did PSBank violate AMLA rules?

There is an Anti-Money Laundering Act (AMLA) that all the banks are supposed to follow, otherwise they themselves are subject to penalties and sanctions.

Did PSBank report the questionable deposits of Corona? He could not have deposited the large amounts without being covered by the AMLA, which are:

Covered transactions are single transactions in cash or other equivalent monetary instrument involving a total amount in excess of Five Hundred Thousand (P500,000) Pesos within one (1) banking day

-the amount involved is not commensurate with the business or financial capacity of the client;

-there is a deviation from the client’s profile/past transactions;

So, did PSBank exercise its functions as required, or did it violate the AMLA and "accommodated" Corona? It was most likely they did the latter. The Senate should look into this.

Foreign Currency Deposit Act specifically states that a disclosure of foreign currency bank accounts can only be made upon written permission from the depositor.
The above paragraph these bankers keep saying like a litany.
What these bankers do not divulge is that such rule only applies to foreign business investors. Corona is not a foreign investors.

If any of the bank themselves is preventing the release of the subpoenaed bank documents
then we,
the Filipino people
should boycott them by withdrawing our accounts from these banks.
we should not support these banks.
I will withdraw all of my accounts from these bank
for the support of the Filipino People.
They should not coddle hoodlum in robes,
and they should not be the protectors of corrupt government officials.

the bond sale and the demand for more bond sale did not immediately happened after psb president garcia rebuffed the request of the impeachment court to disclose corona's dollar account. the sale and demand of the bonds was an ongoing thing long before garcia's rebuff. given time, who knows? maybe some of the depositors of psb bank will do a bank or money run. wait and see.

PSBank will now be known as the banker of the corrupt

PSBank made a decision to favor Corona. It did not just want to clarify the law, because it could have just asked the Senate for that, or ask for more time to study.

Instead it immediately ran to the Supreme Court for help. Makes one wonder if there are more strings attached between this bank and Corona/GMA's group.

In any case, as you sow, so shall you reap. The Filipino people are watching.
