Henares: No special treatment for Dunkin' Donuts franchisee

MANILA, Philippines – Bureau of Internal Revenue (BIR) Commissioner Kim Henares denied the allegations made by a former revenue officer that special treatment was given to a company found to have tax deficiency amounting to P1.56 billion.

Henares said the company, Golden Donut Inc., called the attention of her office questioning the assessment of the revenue officer, Othello Dalanon.

Golden Donut Inc. is the local franchisee of US brand Dunkin' Donuts.

“’Yung kompanya, humingi ng appointment at nagreklamo na ‘yung assessment ay sobrang laki at unreasonable, sabi ko naman sa kanya na kung tama kayo, i-reinvestigate natin,” she told dzMM.

Henares clarified that it is every taxpayers' right to ask for a re-auditing if they feel the assessment was not accurate.

She said two rounds of re-auditing were conducted and it revealed that Dalanon made mistakes in his computations.

However, Henares said she cannot disclose the correct amount because it is confidential.

The tax bureau chief said she made no orders to deliberately not collect the company’s tax deficiency.

“Pina-audit ko lang, wala akong sinabing babaan or what. Pina-audit ko lang para malaman kung ano ang totoo. Pag-audit ulit ng mga tao, wala ako sa proseso na ‘yun, kung ano ang lumabas sa proseso na ‘yun, ‘yun ang tama,” she said.

Dalanon has filed charges of grave misconduct and gross neglect of duty against Henares and another BIR official, Deputy Commissioner Estela Sales, before the Office of the Ombudsman.

Dalanon said he resigned on June 24, 2013 because of alleged irregularities he discovered while he was still with the BIR.
