Tax evasion raps filed vs security agency, Serendra unit owner
MANILA, Philippines - A security agency is in trouble with the Bureau of Internal Revenue (BIR) for allegedly failing to pay taxes for three years.
In a statement, the BIR said it filed a criminal complaint with the Department of Justice (DOJ) against Red Fox Security Inc. and its president Felipe J. Pacleb and treasurer Pedro Cezar for tax evasion from 2008 to 2010.
Red Fox's registered address is at No. 43-F HR Building, Mindanao Avenue, Pag-asa, Quezon City.
The BIR said it had received information about Red Fox from an informant with knowledge of the operations of the company.
The BIR found that Air Materiel Wings Savings and Loan Association, Inc. (AMWSLAI) had paid Red Fox P24.62 million in 2008, P23.46 million in 2009 and P25.52 million in 2010. But Red Fox only declared gross revenues of P5.39 million, P3.69 million and P3.97 million for taxable years 2008, 2009 and 2010, respectively.
The BIR said Red Fox underdeclared its gross revenues by P19.22 million (356%) for taxable year 2008, P19.77 million (536%) for taxable year 2009 and by P21.54 million (542%) for taxable year 2010.
Red Fox was sued for its income tax deficiencies from 2008 to 2010, totaling P57.34 million.
One Serendra unit owner failed to pay taxes
At the same time, the BIR filed a criminal complaint with the DOJ against Shank Kaye, who bought a unit at One Serendra in Bonifacio Global City, for tax evasion and use for fake BIR certificates.
The BIR said Kaye bought the condo unit from Kamari Overseas Limited for P14 million on July 14, 2011. However, the BIR discovered that the sale was fraudulent since the corresponding taxes were not paid before the title was transferred. The tax credit certificate and Condominium Certificate of Title used by Kaye were found to have been falsified.
The BIR said Kaye is liable for the unpaid taxes pertaining to the subject transaction. Kaye was sued for a total deficiency tax liability amounting to P10.96 million, inclusive of surcharges and interests.
