Kris Aquino wants annulment, not separation
MANILA, Philippines - Television host and actress Kris Aquino will be seeking an annulment of her marriage to basketball player James Yap, lawyers said.
In an exclusive interview with ABS-CBN's Marie Lozano, lawyer Anna Liza Logan said the TV host is not seeking legal separation.
Logan is a partner of the Marcos Ochoa Serapio and Tan, the law firm retained by Aquino.
“We will have the court decide na yung marriage was void from the beginning,” she said.
Logan said they are now preparing the petition for the declaration of nullity of marriage. In simple terms, this is called the annulment of marriage.
Once the decision becomes final, the parties are free to enter into separate partnerships once again.
This is different from a mere legal separation, where the bond is only dissolved “in fact.”
Logan refused to answer the reasons behind Aquino’s decision to annul her marriage.
“We can’t pre-empt. Ayaw muna namin. May privacy yung parties. Tapos confidential ang proceedings especially if a child is involved,” she said.
Aquino has a child with Yap, 3-year-old Baby James.
Based on the Family Code of the Philippines “no child under 7 years of age shall be separated from the mother, unless the court finds compelling reasons to order otherwise.”
Logan, however, said Aquino is open to discussing the custody issues with Yap.
She said the contents of the petition will be finalized once Aquino arrives from her 3-week vacation in Orlando, Florida.

Kawawa naman si James...He is not used to this kind of controversy & separation..Kris is very used to this..But James, you're still young & try to focus instead on your basketball career..I admired Kris for her wit & being always at the right side of political fence, but for separating James, she just proved to her detractors that she's really pasaway & spoiled.

if her reason to divorce is due to infidelity then i would agree but if its because she just dont want to be married anymore because of personal problems, emotional drainage,or just being a drama queen etc.. then i would say that she is weak and she is insulting what god has created. she is starting a trend in the philippines. she is setting an example to her many fans and followers that it is ok to run if you dont get what you want and not be accountable. because of her examples, her followers will think that it is ok to divorce just because you dont want to be married anymore. she is a public figure and a role model for many filipinos and its a shame that her low capacity to grasp the concept of marriage. she mocks the values and beliefs to strive, stuggle, and to fight, to the many elders and forefathers that have set examples and standards to marriage. she is an immature imbecile that always tries to get her way. i encourage all the filipinos and non filipinos out there to boycott her movies, products that she promotes, those companies that supports her , and anyone that supports her actions, specially that gay guy "Boy". Boycott his show and anyone that supports him. It is the people who made Kris who she is today and we can take it back. We must teach her a lesson by BOYCOTTING everything what she does. If Chris Aquino wants her marriage life to be private, she should stop releasing statements that she wants an annulment, not separation to James Yap, through
her lawyers at the show biz talk show -"The Bazz". It's clear that she wanted to end this marriage for her own interest. This make her and the Aquino family look bad.
