Why file charges now? Sunshine's lawyer explains
MANILA -- Sunshine Cruz has tried everything to protect Cesar Montano which was why she kept her silence for months before finally deciding to file charges against the father of her three kids, according to the actress' lawyer.
In an interview with DZMM's "Rated Korina' on Wednesday, Cruz's lawyer, Atty. Bonifacio Alentajan, explained why the actress filed a complaint-affidavit before the Quezon City Regional Trial Court in an Anti-Violence Against Women and their Children case against the actor, nearly three months after an alleged incident of rape last May.
"Nag-meeting na kami niyan ng abogado ni Cesar noon. Gusto na lang nila na maayos sana kasi mag-asawa at nangako naman sila na ipagpatuloy namin 'yung sustento P350,000 a month. Tama naman nagbigay si Cesar ng three months na sustento. Pagkatapos noon ay tinigilan na niya. Tapos kung anu-ano pa ang pinaggagagawa niya. So napuno na si Sunshine. Hindi na pwedeng patawarin pa," Alentahan said.
The lawyer also said they have physical evidence to prove that Cruz was raped by Montano.
"May mga pasa. Mayroon siyang pinakita sa doktor. Namula ang pisngi niya, bukol at nauntog sa pader," Alentajan said.
Aside from claims of abuse, Cruz said she has been denied access to her children since July 29, despite her efforts for them to be brought home.
"Galing sa eskwelahan 'yung mga anak, kinuha ni Cesar doon sa eskwelahan noong July 29. Hanggang ngayon di pa niya sinosauli," the lawyer related.
"Ngayon nagte-text 'yung panganay na anak ni Sunshine sa kanya na 'mommy, fetch us we want to go home to you.' Sunod-sunod na text. 'Yung youngest sister daw nila is sick with high fever and is vomiting. Kasi siguro uncomfortable sila sa piling ni Cesar.
"So dapat nga isauli na 'yan na ni Cesar. In fact, nangako na sila doon ng abogado niya na they will make arrangements for the children to be returned to Sunshine. Last week pa. Hanggang ngayon di pa nila sinusauli," the lawyer added.
Alentahan also explained that the rift between Cruz and Montano didn't just begin when the actor became romantically linked to starlet Krista Miller.
"Kasi series ito of incidents hindi lang kay Krista Miller ito, noong araw pa, more than a year ago may ibang iskandalo na 'yan sa ibang babae. Pinapatawad lang ni Sunshine para sa unity ng family at anak niya. Eh ngayon yung anak nila naapektuhan na din," he said.
Asked if kidnapping will be part of the case against Montano; Alentajan said: "Well sa ngayon ayaw pa naming pag-aralan 'yung kidnapping kasi we are giving them the chance to return the children peacefully and orderly."
Alentajan believes that the celebrity couple could still settle their differences out of court.
"Sa nakita ko, nagharap sila sa husgado hindi sila nagbabatian. ...Actually nasa kanila 'yan. Kami ay hindi hahadlang ako, abagodo lang ako. Ang pasya niyan nasa kliyente ko. Kung magkasundo sila, matutuwa ako at ninong pa ako (sa kasal) at saka ang mga bata magkakaroon ng katahimikan sa pamilya," he said.
"Growing children ito. Nasisira ang normal development ng bata. So I would welcome kung talagang magkasundo sila. They are all grown up professionals. Cesar knows what to do. He is a talented actor, director etc. I can not understand why he can not act properly as a husband and as a father," Alentajan said.
