Cudia reiterates plea to join Siklab Diwa Class of 2014

MANILA - Cadet 1st Class Aldrin Cudia, represented by his father, Renato, filed with the Supreme Court (SC) on Monday his reply to the comment filed by the Office of the Solicitor General (OSG) on his petition which seeks a reversal of his dismissal from the Philippine Military Academy (PMA).

Assisted by the Public Attorney's Office (PAO), Cudia reiterated his plea to be included in the list of graduates of PMA Siklab Diwa Class of 2014, including to be awarded his diploma and awards, and other benefits due a graduating cadet.

Cudia stressed that there was grave abuse of discretion on the part of the PMA in dismissing him and preventing him from graduating on the basis of his controversial tardiness in one of his classes.

Cudia reiterated his position that he was denied due process as evidenced by the "unjust and disproportionate" penalty imposed upon him and the absence of a "thorough review" by the PMA itself on his case.

While the OSG pointed out that his petition has already been rendered moot and academic, Cudia said only his physical participation during the graduation ceremonies was mooted, not the merits of his case.

Cudia's case is pending with the high court; so far, no restraining or injunctive relief has been handed down by the SC in his favor.
