Jury selection begins in â€˜ejaculator' case of Fil-Am
SANTA ANA, California –The jury selection began Thursday morning in the strange case of Michael Kevin Lallana, the Filipino-American man accused of ejaculating into a co-worker’s water bottle.
Lallana was present in the courthouse this morning and greeted about 50 prospective jurors with a quick “good morning”.
A short list of 18 jurors has been selected. Judge Walter Schwarm briefly told the room that the case involved Lallana allegedly placing his semen in a water bottle and the alleged victim drinking it.
A few people in the room reacted in disgust and disbelief.
The jury trial is expected to begin on Tuesday and may end as early as next Friday. During Wednesday’s final pre-trial conference, new details of the investigation came out.
The victim had initially complained last summer after she felt sick from drinking out of a water bottle on 2 separate occasions. She took the bottle to a laboratory for testing, where tests found semen in the bottle. However, the DNA results had not yet come in as Lallana and police questioned 5 other male co-workers.
Lallana was among six suspects questioned by local police last July. The initial suspect pool was identified as men who worked with the alleged victim at both the Orange and Newport branch of Northwestern Mutual Mortgage.
The alleged victim has not been seen in the courtroom the past two days, but is expected to testify at the trial.
Judge Schwarm told both lawyers that he would most likely look at the incident as a sexual assault case.
Lallana is facing 6 misdemeanor charges which include releasing offensive material in public, assault, and committing a crime for sexual gratification.
Lallana has denied any wrong doing. If convicted, Lallana could spend up to 3 years in prison.
