MANILA, Philippines - Grace Ibuna, the live-in partner of Ignacio "Iggy" Arroyo, and not his estranged second wife Aleli Arroyo will benefit from the late congressman's trust estate, according to his last will and testament.

A copy of the last will and testament that ABS-CBN News obtained from documents submitted to the UK High Court of Justice did not mention Aleli, who is also claiming Iggy's remains.

Iggy named Bernardina Arroyo Tantoco, his daughter with his first wife Marilyn Jacinto, as the executor of the will that was made in Glendale, California in 2009.

He also named Tantoco as the trustee in the "living trust" that he made before he died.

Upon his death, the trust will issue payments only to Ibuna until her death, according to the will.

Upon Ibuna's death, the remaining balance of the trust estate will go to Iggy's 3 children Tantoco, Bianca Marie Arroyo, and Alicia Lourdes Arroyo.

The last will and testament did not reveal the assets that Iggy owned.

Aleli's lawyer, Atty. Lorna Kapunan, earlier claimed that the late congressman's will cannot be considered valid under Philippine law because it was not allegedly authenticated by the Philippine consulate in San Francisco.

Kapunan also said they had no intentions to appear before the UK court that handled the case involving who has the rights over Iggy's body because they do not recognize its jurisdiction on the case.

Court 31 Justice Peter Smith earlier ordered Aleli to pay the legal costs of the UK proceedings, including the funeral costs that could be up to £94,000 or P6 million.

Smith, however, also acknowledged that the decision could be an "empty order" as the UK court has no jurisdiction to enforce the order in the Philippines where Aleli resides.

Two of Arroyo's children with his first wife have taken the side of Ibuna in her custody battle with Aleli.

Tantoco, in a sworn statement before the UK court, explained her decision why she is supporting Ibuna's claim over the late congressman's body.

She said she wants to make sure that a wake is held for her father at the Arroyo ancestral home and Iggy is buried according to his last wishes.

Tantoco also said that Aleli did not ask about Iggy's condition even if she knew that the congressman was already ill.

She told the court that her father clearly said that he does not want Aleli to be involved in his burial preparations, because of the ugly incidents behind their parting of ways.

Tantoco said Aleli filed charges against her father several times and a court order banned Iggy from setting foot inside his own house.

Bianca echoed her sister's statements.

In a tribute held for their father at the Jesus the Voice of Hope Global Ministries, Bianca thanked Grace for helping her father have a family.

“I'm really thankful kasi siya, hinahanap talaga ng tatay ko na may pamilya siya that he would experience a family life. And they gave that to him. He was really happy. Thank you so much,” Bianca said. - report from Rose Eclarinal, ABS-CBN Europe News Bureau
