CHR to probe if NBI violated Ivler's rights
MANILA, Philippines - The Commission on Human Rights (CHR) on Friday said it would look into allegations of human rights violations committed by agents of the National Bureau of Investigation (NBI) during the arrest of road rage killing suspect Jason Ivler last Monday.
CHR Chairperson Leila de Lima said the independent investigation will not focus on whether Ivler did kill the son of Malacañang official Renato Ebarle Sr. or in the shootout with the arresting NBI team, but only on how the NBI agents handled the suspect during the arrest.
"We will determine the circumstances attendant to the situation. Even he is a suspect, he has rights and should be given proper treatment," De Lima told ABS-CBN's Umagang Kay Ganda.
The CHR decided to look into Ivler's case after his mother, Marlene Aguilar, claimed that NBI agents treated her son like a pig following a shootout with the arresting team. She said this was how a friend described the arrest after watching a video of it posted on video sharing site, YouTube.com.
"My son was already handcuffed... Tinutukan daw siya ng isang agent sa mukha tapos tinadyakan ang tiyan. Itinapon daw na parang baboy sa sasakyan (An agent kicked him in the stomach while a gun was pointed to his face. He was thrown like a pig to a vehicle)," Aguilar told reporters after visiting her wounded son at the Quirino Memorial Medical Center in Quezon City on Wednesday.
Aguilar called on the CHR to investigate the NBI agents for violating her son's human rights.
De Lima said that the CHR has yet to see the raw footage of the NBI's raid at Aguilar's home in Blue Ridge village, Quezon City. She said they intend to get both sides of the story--from Ivler's family and the NBI.
She said the CHR would want to know the circumstances on why the NBI allegedly kicked his son and threw him into a car like a pig.
Footage taken by ABS-CBN's Maan Macapagal, who was inside Aguilar's residence to cover the arrest, showed the NBI agents being fired at by Ivler from a supposedly "secret room."
The footage also showed the wounded Ivler being pinned to the ground by the NBI agents. At least 2 agents had their feet on Ivler's stomach and chest. The suspect was visibly trying to struggle from the hands of the arresting agents.
The footage also showed Ivler being carried by NBI agents as they went out of Aguilar's residence to bring the suspect to the hospital because of his gunshot wounds.
NBI denies violating Ivler's rights
Meanwhile, the NBI denied that it violated the rights of Ivler or Aguilar during the arrest.
NBI Director Nestor Mantaring said that at the height of the encounter inside Aguilar's house, they even thought of securing Marlene.
He said the arresting team even asked her to lead in entering the room where Jason was hiding.
After the NBI agent already captured Ivler, he continued to resist arrest and even threatened NBI operatives.
The arresting team also decided to quickly bring Ivler to the hospital due to his gunshot wounds, Mantaring said.
The NBI said it is prepared to answer the allegations of human rights violations if Aguilar will insist that there her son's rights were violated. -- reports from Jeff Canoy and Maan Macapagal, ABS-CBN News

This is probably self explanatory nuff said, no need to elaborate. So dont blame CHR.

Mga tiga CHR, bakit kapag ang criminal ang nasasaktan or napapatay ay katakot-takot na imbestigasyon ang ginagawa ninyo, pero kapag yun mga law enforcers natin ang nasasaktan or napapatay ng mga criminals ay hindi kayo nagiimbestiga? Iimbestigahan nyo kung meron paglabag sa karapatang pang-tao ang mga NBI sa paghuli kay KILLER JASON IVLER, eh bakit HINDI nyo rin imbestigahan yun pamamaril na ginawa ni Jason Ivler dun sa 2 NBI agents na nabaril at tinamaan nya?! Si Jason Ivler ang mas maraming human rights violation at maraming kasalanan sa batas at sa mga biktima nya, pero siya pa rin ang kinakatigan nyo. Pano naman po yun mga biktima nya?
