Megaworld told to submit proof Corona's condo sustained typhoon damage
MANILA, Philippines (2nd UPDATE) - An official of Megaworld Corp. told the impeachment court on Tuesday that they voluntarily gave Chief Justice Renato Corona a P10-million price reduction for his penthouse unit in The Bellagio, Taguig City due to "force majeure" and not for any consideration from a high-ranking government official.
Megaworld senior vice-president for marketing and sales Noli Hernandez said the penthouse sold to the Coronas was originally priced at P24 million, but “unfortunately, a typhoon struck and the unit sustained damages.”
He said they gave a nearly P5-million price reduction--from P24 million to P19.6 million--to the chief justice. Hernandez said the price reduction would have been given regardless of who the buyer was.
Hernandez added the selling price was later reduced by another P5 million, representing discounts and other factors because the Coronas were prompt payers. They paid in four installments in about a year.
Hernandez said he did not even know it was the Coronas who were buying the penthouse unit.
Upon cross-examination, he said the Megaworld cases before the Supreme Court does not have anything to do with the transaction. “In fact, we lost a total of P47 million in the 2 cases.”
He is referring to Megaworld Globus Asia versus Tanseco, which the SC disposed on October 9, 2009. There, Megaworld lost that case for its failure to complete and deliver a condominium unit to its buyer. Megaworld was ordered to pay P21 million.
In another decision in 2007 entitled Megaworld Globus Asia Inc versus Clerica Holdings Inc., the court also ordered Megaworld to pay a client around P26 million.
Both cases were concurred in by Corona.
Damages
Hernandez was made to appear before the Senate, sitting as an impeachment court, today since another officer who was subpoenaed could not speak on the pricing of the condominium units.
He said he was the one who negotiated for the property in question, but did not know it was the Coronas who were trying to purchase the unit. He said it was Corona’s wife, Cristina, who was the one who faced his staff and informed them of their intention to buy.
Private prosecutor Joseph Joemer Perez tried to deduce from the witness that the P10 million was a discount that should not have been accepted by Corona, but Senate President Juan Ponce Enrile several times twitted him for cross-examining a witness.
“You’re twisting his answer, the reduction is done voluntarily by the seller. So it can’t be said that it’s a discount, they’ve lowered the price themselves,” Enrile told Perez.
Hernandez said it was also his decision to drastically reduce the price since the company was confronted with a global recession.
At some point, senator-judge Manuel Villar stood up, saying it was a market strategy to even give out discounts as high as 40%. He said there was a firm last year that offered its units at a 40% discount.
He did not immediately disclose it was SM Development Corp., drawing laughs from the audience. Villar is the owner of Vista Land, a competitor of SMDC.
Several senator-judges questioned the relevance of the testimony, saying it does not reflect the allegation in article 2, which is the non-disclosure of Corona’s statement of assets, liabilities and net worth.
The prosecution, however, manifested that they are still trying to prove their case, and that Corona should have disclosed the money he used to fix the damaged unit.
Hernandez was also asked by senator-judges to bring to court the engineer’s reports and other documentary evidence to support the company's claims that the penthouse unit sustained damages. The witness said he would submit the documents if they are still in the company's records.

I do not want to be made a laughing stock of other countries...we might be in need of investors as cayetano said...but we just can not let them mocked us or made us idiots...what the megaworld witness did is clear...defiance of us all filipinos...it was very clear that in his inconsistent statements...and not sure knowledge of the facts on the actual damages and insurance of the unit in question but very prepared documents on the cases at the Supreme court of the megaworld...we can see that he was very prepared to show to the world that the allegations of the prosecution is not true! In whatever means and ways, even in falsehood they will do it!
Big Cut! I just wonder if the developer has a record of
justification of this big discount. Pictures of the damages why it's discounted.. I know investor would like to know the reason of discount. I bet some of condo owners would like to know too because if Corona's Unit is cheap it should affect the value of others property in the building? By the way did you go public about the discount siguro may mas nag bid ng mas mataas kaysa kay COrona. Ginagawa talagang tanga ang mga Filipino.

they should not have called Hernandez as their witness. IMO.
if it is still not evident to everybody... i think right now, it's fair to say that the prosecution are acting like deers in front of headlights... they are so lost, it seems they are too incompetent for the job.
anyways, their case against Corona is really WEAK, so maybe I can't blame them for sucking so much.
as of the moment, it seems like this "impeachment trial" is nothing but a witch-hunt, a fishing expedition, ordered by President Aquino because he was hurt when he realized he can't appoint his own CJ
Bribery is a 2 party crime
Megaworld is obviously trying to cover up its complicity in Corona's purchase or rather in their gift to him. Because bribery is committed by 2 parties. Both the giver and the recipient.
But they better rethink their position. After this impeachment trial, people will distrust them. More so if it is proven they were in connivance with Corona.

and that condo was damaged by typhoon. How much it would cost to fix it and sell it at the original selling price rather than give a discount?

Nataranta na yata si Hernandez, salu-salungat ang sinasabi parang nagsisinungaling tuloy na parang may pinoprotektahan. Marami raw gustong bumili but he mentioned that he gave them to Coronas because he knows due to they were their previous client.
Sabi pa ni Hernandez mahirap daw magbenta kaya binigyan ng ganoong kalaking discount? Take note, last unit na raw yun dahil sold out na ang lahat, yun ba ang mahirap ibenta?

It is also a normal practice that the construction damage caused by Force Majeure is insured. Therefore, there will be no extra cost for the developer to repair it due to the insurance will pay the repair. All they need is the Incident report and photos as a proof, then insurance will inspect it, concur the cost of damage ang pay it.
Nakakatawa lang na bukod sa last unit na raw yun, yung penthouse lang na yun ang nadamaged.
Kapag hindi naipakita itong incident or Engineering report na ito, halatang may pinagtatakpan, dapat din i-cross verify sa insurance company yan kung nagclaim sila.
2008 pa lang yan, normally, ina-archived lang yan, ewan ko lang kung mauuto nitong si Hernandez ang mga Senators-Judges.

So what if there was a big discount, there are so many factors that come into play when realtors give a discount and trying to insinuate malfeasance for the discount is grossly unfair. News outfits are just trying to make hills out of moles, this issue is hardly worth headlining.
