Court junks graft case vs ex-Coast Guard chief

MANILA, Philippines - The Sandiganbayan has junked a graft case filed against Vice Admiral Edmund Tan, the former commandant of the Philippine Coast Guard, a radio dzMM report said Monday.

In a 16-page decision penned by Sandiganbayan Fourth Division Associate Justice Ma Cristina Cornejo, the court ruled that Tan was only doing his job when he detained a shipment of iron ore in 2007.

Tan earlier said the barge LCT Kapitan was held back from transporting its shipment from Zamboanga to Manila due to a court order of the Pagadian regional trial court and due to safety and environmental concerns of the Department of Environment and Natural Resources-Region 7 office.

Businessman Reynaldo Chua later sued Tan, saying the delay cost him P500,000. Tan was suspended for 90 days last year until his retirement in December 2012.
