Bernas: SC can intervene in CJ trial
MANILA, Philippines - Constitutionalist Fr. Joaquin Bernas said the Supreme Court (SC) can intervene in case there is grave abuse of discretion on the part of the impeachment court in trying Chief Justice Renato Corona.
During the oath-taking of the officials of the Philippine Constitutional Assembly (Philconsa) on Thursday, Bernas said the SC was given powers by the Constitution to determine the meaning of laws.
He recognized that the House of Representatives has the power to initiate impeachment complaints while the Senate has the sole power to hear such.
He stressed, however, that the Constitution tasked the high court to intervene on the ground of grave abuse of discretion.
He noted that the SC took this step in the impeachment complaints filed against then-Chief Justice Hilario Davide Jr. and former Ombudsman Merceditas Gutierrez.
He said the SC resolved issues concerning the interpretation of the “law of impeachment.”
“[What] All these mean is that the SC can come in when needed to determine the meaning of the law,” Bernas said.
The Constitution does not impose superiority in the SC, he said.
“All it means is that the constitution has placed in the SC the power to determine with finality the meaning of the law. It means the superiority of the Constitution and it just so happens that in the constitutional structure of our government, there is separation of responsibilities,” he said.
“There is no superiority of one over the others, there is only superiority of the Constitution over all," Bernas added.

Kasi Group silang gumawa sa ating Constitution.

Hindi ako maniniwala.
Kaya dapat ituloy ang Impeachment.
Hindi dapat ito (Impeachment) paki-alaman o panghimasukan ng Supreme Court.

Na nabuo na ang ating Senate Impeachment Court.

Kapag nabuo na ang Senate Impeachment Court.
At nakapag-take oath na as Senator Judges ang ating mga Senators.
Sila lang dapat ang mag-try o mag-decide kung nasunod ba ng House of Representatives ang buong Section 3.
Wala ng iba.
Hindi ito pwede pakialaman o panghimasukan ng ating Supreme Court.

Nasa Constitution yong mga government official dapat magdivulge ng SALN sa public. Kung di superior ang SC, bakit nagawa nilang mag issue ng circular na ang mga justices ng SC ay pwede lang magfile at di di pwedeng ilabas sa public on their assumption, suspicion na baka gamitin ito sa kanila kung gagawa sila ng adverse decision. Kung ang executive, senate at congress ay di exempted, bakit sila nagagawa ito. Asan ang co equal dyan. Sabi nga ng defense ni Corona yong ill gotten ay suspicion lang kaya sila nag oobject. Mag oobject din ako dahil suspicion lang na baka gamitin sa kanila. At kung wala kang ginagawang pagnanakaw ano ang kinatatakot ng mga justices para ilabas ang SALN at gamitin against them
