SC can't stop Senate on CJ bank subpoenas: Lacierda
MANILA, Philippines (UPDATE) - Malacañang believes that the Supreme Court (SC) cannot stop the Senate impeachment court from implementing its order asking bank officials to produce the bank records of Chief Justice Renato Corona.
Presidential spokesperson Edwin Lacierda said that the Supreme Court "has no jurisdiction" over the Senate sitting as impeachment court. He said that the impeachment court is "supreme" when it comes to holding impeachable officials accountable.
"The Constitution is very clear on the matter. The Senate has sole and exclusive jurisdiction over impeachment cases. The House impeaches, the Senate tries. At no point did the Constitution envision encroachment by the SC over the Senate sitting as an impeachment court since the latter is meant to hold accountable impeachable officials which include the members of the SC. In cases of impeachment trials, SC has no jurisdiction," he said.
Lacierda believes there will be no constitutional crisis in the event that the Supreme Court issues a Temporary Restraining Order (TRO) against the Senate impeachment court, saying that the mandate of the Senate impeachment court is clear.
He added that Corona's move to seek a TRO from the Supreme Court is the chief justice's way to look for "a friendly venue" to voice out his position.
Lacierda said that Corona should have nothing to fear in producing his bank records if he has nothing to hide.

May nasasaad ba sa constitution na hindi subject sa judicial review ang impeachment court? Mahirap ibigay ang ganyang klaseng kapangyarihan sa senado na puro pulitiko. Kung ako sayo, kumbinsihin mo din sana ang pangulo na ipatupad yung halaga na sinabi ng SC na dapat ibayad sa Hacienda Luista Inc na yan, at hindi yung 10 Billion pesos na gusto nila.

Gusto nyo ma-impeach yung ibang tao sa SALN eh sangkaterba pala mga senador (at sigurado pati mga tongresista) ang palpak ang mga SALN. Mapapangako ninyo ba samen na mapapatalsik nyo lahat mga yan dahil sa SALN? ang sagot, HINDI!

Saka wag na kayo makisawsaw sa impeachment kasi hindi na kayo kasali dun! Asikasuhin ninyo yung problema ng bansa at mga nalindol!
Lacierda Can Say What Pnoy Wants Him To.
Lacierda is not bound by the rules of the law but by the rules of his employer. Whatever his employer says, he does. His views does not reflect his knowledge with the law but his loyalty to his employer. It is now obvious that his views were wrong because a TRO was just issued against the impeachment court regarding issuing subpoenas on the dollar account.
