PNoy dares Corona to present dollar accounts

MANILA, Philippines - President Aquino challenged Chief Justice Renato Corona to present information on his dollar accounts if he has nothing to hide.
 
“Public servant tayo, may public trust na kasama dun. Maganda sana magboluntaryo na 'yung nasasakdal, walang tinatago, buksan nyo para makita nyo wala akong kasalanan,” Aquino told reporters during the launch of the TESDA Specialista Technopreneurship Program (TSTP) on Friday.
 
Aquino believes that the law on foreign currency deposits is not meant to provide “refuge” to those who committed injustice. “Those who committed an injustice should not take refuge in this particular law,” he said.  
 
“Pag ikaw e magnanakaw—hindi ko sinasabi ‘yung nasasakdal ay nagnakaw—pero kung nagnakaw ka, ilagay mo sa isang foreign currency, pwede mo nang itago sa pag-iimbestiga? Hindi naman siguro ganun ang layunin ng mga nagsabatas nito… Pwede mag-encourage ng mga depositors pero hindi naman siguro natin hinihikayat 'yung mga drug lord ng ibang bansa, ‘Halika punta kayo dito sa Pilipinas, dito hindi masisilip 'yan,” Aquino said.
 
Aquino likened the Supreme Court’s temporary restraining order on the subpoena on Corona’s dollar accounts to the TRO issued against the watchlist order on former President Arroyo.
 
“Masyadong mabilis 'yung proseso. Imbes na 10 days naging three days, parang walang pagdidinig ng oral argument. Bago mapag-usapan ang isyu, pakakawalan na siya noong panahon na ‘yun. So parang ang hirap hindi paniwalaan na parang pareho ng pag-iisip doon sa pag-apply ng TRO,” Aquino said. 
 
“Pero may mga proseso namang nakalaan... ‘yung mga dalubhasa nating abogado iniisip nila mag-apila or andun din naman 'yung nasa Constitution na 'yung sole and exclusive power resides in both the Congress and the Senate. Parang hinati ‘yung impeachment dun sa dalawag sangay ng gobyernong ‘to at may pananaw na hindi sila pwedeng panghimasukan ng ibang branches of government.”
 
Asked if he believes that the issue may result in a constitutional crisis, Aquino said it remains to be seen how the Senate would respond, adding that nobody wants a constitutional crisis to happen. “Walang may gusto ng constitutional crisis,” he said. 
 
Aquino said the TRO may have an effect on the economy, saying the global financial community may impose sanctions on the country, being a signatory to treaties against money laundering. “So may dagok sa ekonomiya 'yan,” he said.

ACCUSATION: article 2 of the impeachment complaint alleges corona for violation of the constitution and or betrayed public trust when he failed to declare his SALN.

paragraph 2.1 and 2.2 of article 2 alleges the non-disclosure of CJ's SALN.

THE TRUTH: after sen-judge drilon managed to extract the SALN of corona, it marked a clear victory for the defense panel. after the impeachment court proved that corona regularly files his SALN, the prosecution announced that they are abandoning the accusation of non-disclosure of SALN since it was clearly proven that the defendant regularly files his SALN.

paragraph 2.3 of article 2: alleges that the CJ failed to declare some of his properties accurately in his SALN and that he committed perjury.

THE TRUTH: it was proven that the prosecution's accusation that corona owned 45 properties is nothing but a bloated list. more importantly, the law allows corrections in CJ's SALN. that being the case, no law has been violated not even perjury is applicable.

paragraph 2.4 of article 2: alleges that corona amassed ill-gotten wealth.

THE TRUTH: what many people should know is that the senate itself made a ruling that par. 2.4 of article 2 will no longer be tackled since article 2 itself does not allege corona of amassing ill-gotten wealth. the prosecution is prohibited by the senate impeachment court to tackle par. 2.4 of article 2. the prosecution needed to cure article 2 or toss the impeachment complaint back to prostituted congress before they can be allowed to touch the issue of ill-gotten wealth.

Did PSBank violate AMLA rules?

There is an Anti-Money Laundering Act (AMLA) that all the banks are supposed to follow, otherwise they themselves are subject to penalties and sanctions.

Did PSBank report the questionable deposits of Corona? He could not have deposited the large amounts without being covered by the AMLA, which are:

Covered transactions are single transactions in cash or other equivalent monetary instrument involving a total amount in excess of Five Hundred Thousand (P500,000) Pesos within one (1) banking day

-the amount involved is not commensurate with the business or financial capacity of the client;

-there is a deviation from the client’s profile/past transactions;

So, did PSBank exercise its functions as required, or did it violate the AMLA and "accommodated" Corona? It was most likely they did the latter. The Senate should look into this.

Foreign Currency Deposit Act specifically states that a disclosure of foreign currency bank accounts can only be made upon written permission from the depositor.
The above paragraph these bankers keep saying like a litany.
What these bankers do not divulge is that such rule only applies to foreign business investors. Corona is not a foreign investors.

If any of the bank themselves is preventing the release of the subpoenaed bank documents
then we,
the Filipino people
should boycott them by withdrawing our accounts from these banks.
we should not support these banks.

SALN versus Bank Secrecy Laws

sa banggaan ng SALN at bank confidentiality and secrecy laws, panalo ang SALN. ibig sabihin, kailangan ilabas lahat sa SALN ang ariarian ng isang opisyal, kahit nakalagay pa sa foreign currency account. hindi nagbigay ng exemption ang batas sa klase ng assets o cash on hand na kailangan i-disclose sa SALN ng public official. dapat i-disclose lahat sa SALN at pwedeng busisiin, kasama din idisclose at busisiin yun foreign currency deposits kahit "absolutely confidential" kuno, kasi sabog ang intent of the law sa SALN kung yun mga magnanakaw sa gobyerno itatago na lang ninakaw nila sa foreign currency deposits tapos wala nang pwedeng makakita, kahit DOJ, husgado, o impeachment court. yun karapatan ng isang tao sa "absolute privacy and confidentiality" ng foreign currency deposits ay mahihigitan ng karapatan ng mga nakararaming mamamayan sa ilalim ng public interest doctrine ng batas, at ang SALN ay to protect the public interest. klaro sa batas na mauuna ang public interest kaysa personal interest. also, nauna lumabas ang foreign deposits secrecy law, huli ang RA6713. sa batas , yung huling batas, binabago nya epekto noong naunang batas kung may conflict ng epekto.

Corona Should Disclose Dollar Accounts

Govt employees from top to bottom are required by law to make a public disclosure of all their assets including cash on banks, and in fact, one of the reasons why Corona is being impeached was his failure to disclose his assets accurately and on time. Now, the impeachment board is in a quandary over what to do with Corona's several bank dollar accounts which Corona REFUSES to make public during the trial and on nationwide TV coverage. Why is he being allowed to do that? By doing that isn't he openly committing the exact offense which he is being accused of - failure to disclose assets including cash on banks? My gosh, he has not only failed to disclose but he continues to fail and continues to refuse to disclose, and he is doing it right in front of the senator-judges who are tasked to find out if he has indeed committed that offense!

I do really believe that all of our public officials on the national level have their $ account/s which is legal to own one anyway but, unfortunately SC Corona has been a victim of "bullies" and mobs. I'll bet that PNoy has his own dollar account stashed somewehere. Dare?

It should begin from the President down to the mayors. Mr. President, be a model to all. Be transparent to the public to all your assets including your bank accounts whether peso or dollar accounts. Dyan bebelieve ang sangbayanan nga malinis ka at hindi corrupt which I doubt. Common Mr. President, I dare you to open also your bank accounts.
