MANILA -- The lawyer of property developer Delfin Lee on Friday denied that his client is trying to apply as state witness.

"There is no such thing... the case had already been dismissed by the Court of Appeals. There is no ground to even apply for state witness," Atty. Willie Rivera said.

Rivera also said that he clarified this matter from Lee himself, who said he made no such statement.

"Most probably Atty. Repizo is mistaken. He actually told me that all questions should be forwarded to me because I am the spokesperson of Delfin Lee," Rivera said.

According to Rivera, Atty. Gilbert Repizo had not been engaged by Lee to represent him in this case.

"I think he was just mistaken. Most probably he's making his own assumptions," Rivers said of Repizo.

Meanwhile, Rivera said he is surprised why the Philippine National Police arrested his client because no less than PNP director General Allan Purisima wrote him, saying they would comply with the order of the Court of Appeals.

"We're filing a petition for the issuance of habeas corpus by Monday in order to have the release of lee by the Court of Appeals," Rivera said.
