CA denies Lozada petition to subpoena top govt officials
The Court of Appeals denied on Thursday the motion filed by the camp of Rodolfo Noel "Jun" Lozada to subpoena government officials involved in his alleged abduction as hostile witnesses in the hearing on the writ of amparo.
The CA ruling means the court will not require the appearance in court of Environment and Natural Resources Lito Atienza, National Police chief Director General Avelino Razon Jr., Commission on Higher Education Chairman Romulo Neri and airport security officials to testify on alleged threats to Lozada's life, liberty and security on the ground that it is irrelevant.
Lawyer Rex Fernandez , Lozada’s lawyer, said they will file a motion for reconsideration on the resolution.
"Petitioner has right to call witness, premature to say irrelevant unless we've heard their statement… We think its relevant kasi alam nila kung ano nangyari kay Lozada noong ayaw siyang ipa-testigo," said Fernandez.
Fernandez insists that they need to ask the said officials questions that are relevant to Lozada's petition for protection from the court.
The CA is hearing the petition for the writ of amparo filed by Lozada’s brother.
Lozada is the latest star whistleblower in the Senate’s probe into the allegations of bribery and overpricing in the scrapped national broadband network deal between the government and China’s ZTE Corp.
When he arrived from Hong Kong early February, Lozada said he was abducted to prevent him from testifying in the Senate probe. Even though he is still under the protective custody of the Senate and is being assisted religious organizations, he said there are continuing threats to his life.
Meanwhile Fernandez also said that the complaint filed before the Ombudsman against Lozada is a harassment case.
