US court rules vs Aquino's request for Mancao
The US District Court of New Jersey has denied the request of former police Senior Superintendent Michael Ray Aquino to secure Senior Superintendent Cezar Mancao II and former Superintendent Glenn Dumlao for his extradition hearings.
The order, penned by US Magistrate Judge Esther Salas, turned down Aquino’s motion for writs of habeas corpus for Mancao and Dumlao so they could appear in his extradition hearings.
However, the US court allowed Aquino to secure depositions from Mancao and Dumlao for his defense prior to Aquino's extradition hearing set on July 1, 2009.
“This Court deems that it has the discretion to authorize Aquino to secure limited discovery. Moreover, this Court is satisfied that Aquino is seeking to elicit ‘explanatory’ evidence from both Dumlao and Mancao's affidavits,” said the court order.
"This court shall permit Mr. Aquino, through his counsel, to depose Dumlao and Mancao. Both depositions shall be taken in the presence of the assistant US attorney," said the US court.
Aquino, who was earlier tagged by Mancao and Dumlao as among those involved in the murder of PR man Salvador “Bubby” Dacer and his driver Emmanuel Corbito, believes that the testimonies of the two former PNP officials may help him stop his extradition to the Philippines.
The former police official claimed that he was only implicated to the murder case following the statements submitted by both Mancao and Dumlao.
Aquino said that both testimonies from his former PNP colleagues were obtained under duress.
Like Aquino, Mancao and Dumlao are also subject to extradition.
Mancao and Aquino were former members of the now defunct Presidential Anti-Organized Crime Task Force, which was headed by former Philippine National Police chief and now opposition Senator Panfilo Lacson.
