Court orders PNP to return Napoles to jail

MANILA (UPDATED) - The Makati Regional Trial Court (RTC) Branch 150 has denied the motion of alleged pork barrel scam mastermind Janet Lim Napoles for an extended stay at the Ospital ng Makati (OsMak).

Makati RTC Branch 150 Judge Elmo Alameda on Tuesday ordered the Philippine National Police (PNP) to return Napoles to Fort Sto. Domingo in Sta. Rosa Laguna not later than May 23, Friday, exactly a month after her operation.

Napoles, who is detained for a serious illegal detention case filed by pork barrel scam whistleblower Benhur Luy, underwent an operation to remove a tumor in her uterus at the OsMak last April 23.

In his decision, Alameda cited the testimonies of Napoles' personal doctors, who have already given the go-signal for her discharge from the hospital.

Alameda also said that the facilities inside Napoles' detention cell will be sufficient for her needs.

The head of the Philippine National Police (PNP)-Calabarzon Health Services told the court during Tuesday's hearing that they are ready to receive Napoles back in Fort Sto. Domingo.

The PNP also said arrangements could be made for Napoles, like bringing in more electric fans inside her detention cell, after Napoles' lawyers and attending physicians said she needs a very clean and cold room in order to fully recover.

Napoles' camp had asked Alameda to give them an opportunity to present somebody from the Department of Justice (DOJ) or the National Bureau of Investigation (NBI) to testify that Napoles still needs more time to stay at the hospital.

Her lawyers, this time, cited security reasons, as Napoles has yet to finish her supplemental affidavit for the pork barrel scam case.

Alameda, however, slammed the lawyers' statements, saying that his court is hearing the illegal detention case and does not have anything to do with the pork barrel scam case.

In an interview with ANC's "Top Story" on Tuesday afternoon, Sr. Supt. Wilben Mayor, spokesman for the PNP chief, said they will abide by the court order to escort Napoles back to her detention cell not later than Friday.

Mayor said preparations are now being made for Napoles' security and transfer to Fort Sto. Domingo.

He said a nurse will be assigned to Napoles, and an ambulance will be posted outside her detention cell in case of an emergency. -- Report from Doris Bigornia, ABS-CBN News
