Kho's lawyer backs anti-voyeurism law
The lawyer of embattled cosmetic surgeon Dr. Hayden Kho on Friday said she is backing the passage of a law that would criminalize voyeurism.
Atty. Lorna Kapunan, Kho's lawyer, said videos of her client having sex with various women touches on the subject of voyeurism and pornography. She said those who distributed the videos should be punished.
"This was meant for private consumption. Whoever downloaded that for either commercial gains or for other reasons should be held liable because of pornography. Hayden didn't do that," she said in an interview at ANC's "Top Story."
"Pornography is a crime against both sexes. There really is a need for legislation. We must have an anti-voyeurism act," she added.
Even before the issue of Kho's sex videos erupted, Sen. Miriam Defensor Santiago has already filed a bill to criminalize photo and video voyeurism.
Pornography is the depiction of explicit sexual content for the purpose of sexually exciting the viewer. This can come in the form of literature, photos, sculptures, sound recordings, and videos.
Voyeurism, on the other hand, is the practice of spying on people engaged in intimate behaviors, such as sexual intercourse, without their consent. This could be done by observing the subject from a distance, or by using objects such as cameras.
On Wednesday, Halili accused Kho, her former lover, of violating the Republic Act 9262 or the law on violence against women and children for videotaping their sexual trysts without her consent. The video circulated in the Internet, sparking a nationwide controversy.
But according to Kapunan, Kho informed Halili that they would be taping the sexual act. Having said this, she said Halili is not exactly blameless in relation to the scandal.
"Hayden said Halili knew she was being videotaped and did not object. As a matter of evidence, we can see this in the tape itself," she said.
Despite this, Kapunan made it clear that Kho is not claiming that he is innocent. She said Kho is willing to suffer the legal consequences for his actions if he is found guilty of violating the law.
However, she stressed that Halili should first prove her charges. "As we speak, the public has already condemned the accused (Kho)," she said.
Earlier today, ABS-CBN News was able to get an exclusive interview from Kho. Consistent with the statement he released Thursday night, he apologized for the proliferation of the sex videos, saying that such were uploaded and reproduced without his knowledge and consent.
