MANILA - The former head of the Training and Research Center is asking the Supreme Court to stop the Office of the Ombudsman from prosecuting him for his alleged involvement in the multi-billion pork barrel scam.

In a 70-page petition for certiorari with application for preliminary injunction and/or temporary restraining order, ex-TRC chief Antonio Ortiz described as "selective prosecution" the decision of the Ombudsman to file graft charges against him.

He noted that whistle-blowers such as Benhur Luy, aide of alleged pork scam mastermind Janet Lim Napoles, admitted participating in the scam but were not charged.

"The alleged four whistle-blowers cannot yet be utilized as state witnesses because only the Sandiganbayan can discharge them as accused in the plunder case and be utilized as witnesses for the State, upon proper motion by the prosecution," Ortiz said.

The SC earlier junked Ortiz's petition seeking to stop the Ombudsman from proceeding with its preliminary investigation in connection with the P10 billion pork barrel scam.
