Napoles asks SC to junk plunder raps

MANILA -- Alleged "pork barrel" scam architect Janet Lim Napoles urged the Supreme Court (SC) to nullify the arrest warrant and criminal cases against her before the Sandiganbayan in connection with the multi-billion peso scam.

Filing three separate petitions before the high court, Napoles argued that the Office of the Ombudsman committed grave abuse of discretion when it found probable cause to indict her for plunder and graft before three divisions of the anti-graft court.

Napoles's co-accused, Senators Juan Ponce Enrile, Bong Revilla, and Jinggoy Estrada allegedly endorsed fake Napoles NGOs as implementors of several projects under their Priority Development Assistance Fund (PDAF), and received millions in kickbacks and commissions from Napoles.

Napoles told the high court that the informations against her "failed to establish that the common purpose or goal of the accused was to enable any public officer to amass, accumulate or acquire ill-gotten wealth."

She claimed that there was no evidence against her to prove that she acquired ill-gotten wealth from the proceeds of the scam.

"Evidently, the crime allegedly committed by the petitioner in conspiracy with her co-accused appears to be a violation of the Anti-Graft Law or maybe the Revised Penal Code on bribery, which were not likewise sufficiently established as discussed but not plunder," Napoles said.

She also denied any affiliation with the NGOs being linked to her.
