'Unlawful to shoot hostage-taker during talks'
MANILA, Philippines - Amid criticisms of the Philippine National Police's (PNP) handling of the hostage crisis, a senior police official defended the moves taken by the policemen who dealt with the incident, saying it was too early to make conclusions.
Speaking on ANC's "The Rundown" on Tuesday night, National Capital Region Police Office (NCRPO) chief Director Leocadio Santiago said they did everything by the book, including not shooting the hostage-taker, dismissed police officer Rolando Mendoza, when there was an opportunity to do so early Monday morning after an elderly hostage was released from the hijacked bus.
He said it is unlawful to shoot the hostage-taker if his captives are not being harmed. He pointed out the rule is to exhaust all means before using deadly force.
"It is unlawful for us to shoot the person when he is doing no harm to his hostages. The rule is to exhaust all means," Santiago insisted. "Until the situation calls for an offensive, the tactical force would only be to encourage him to surrender to authorities. As long as there is no mortal harm, we can't consider him a target for neutralization."
Santiago, a former commander of the PNP Special Action Force, also appealed to the public to reserve judgement until the investigations are concluded.
"On lapses, I would say it's an early conclusion," Santiago said.
"In the initial stages of operations, the bus was properly isolated. The succeeding event, however, when things started to deteriorate, especially after the tactical assault, that's the time we saw there was a breakdown in the isolation," he said.
Many observers have pointed out how the police seemed ill-equipped and even unfamiliar with the operation.
"Unfortunately, the police were not familiar with the bus. It was through text messages that we were informed (of a secret door) and we directed our troops towards that," he said.
News blackout?
Santiago noted that early on, the crisis team could have kept the media at bay and called for a news blackout.
"The request should've been a time lapse on the press releases," he said.
But Santiago said initially, it may have also been in the country's best interest to show the conduct of police operations and positive developments with the release of hostages.
"Since foreign nationals were involved and events were leading to a peaceful resolution, it would've been an advantage to show the world we were following the ABCs of the hostage situation."
Gov't-issued weapons
Santiago noted that normal police procedure involves a review of the accountability of a dismissed police official, and having him surrender government-issued weapons or risk facing court.
"The normal procedure is, once you're dismissed, the accountable officer reviews the accountabilities and a demand is made for him to surrender government-owned equipment. If this is not returned, a criminal case is filed in court."
Santiago believes the outcome would have been different had Mendoza's brother Gregorio not overreacted to efforts to isolate him from the incident. Instead, footage of efforts to subdue and restrain Gregorio enraged Mendoza, reportedly sending him into a shooting frenzy.
Rush probe
Santiago said the police was rushing its probe, starting on Wednesday, to get to the bottom of the tragic incident amid criticism it bungled its operations.
Santiago said a 2-part investigation aims to review the PNP's entire organizational structure and how tactical units respond to hostage-taking incidents. It seeks to identify accountability in Monday's police operation.
"There is still much room for improvement and there are things we should consider in light of this incident. Is it right to have these tactical units and at what level? Externally how could other agencies assist these operations," Santiago said, noting the health department could have immediately sent ambulances to the scene.
Santiago noted it is standard police practice in other countries to use blinders or a smoke cloth to cover a police operation from public view.
Saying it's worth the investment, he noted they had conducted a review before the hostage-taking, and during a briefing with President Benigno Aquino III, the chief executive had expressed openness to building up the capability of the PNP and the country's armed forces.

The PNP's job is to take this guy down no matter what. This means pouncing on every opportunity when he's distracted or not holding a weapon. Anything else is just BS. The Israeli defense forces, who have a long history of dealing with terrorist violence, developed this little nugget of wisdom a long time ago. There is no such thing as "chivalry" during a hostage situation.
What Rules? What Book?
The hostage-taker was armed and dangerous, and should have been dealt with decisively. As a British expert has stated that the rule should be that if in the course of negotiations an opportunity arises to end the situation decisively, it should be taken.”
The situation was fluid that anything can change the demeanor of the hostage-taker. He should have been shot by snipers around the area if only to disable him.

"SWAT"
you guys have been watching too many Bruce Willis and Sylvester Stallone movies. please remember, not all things that happen in a movie is exactly true. have you watched the reality tv series "SWAT". i guess no because most of you would rather watch the "mushy" telenovelas during primetime. for those who don't watch it, "SWAT" is a program that shows how real SWAT in the US handle different situations, including hostage situations. there is one standard rule in SWAT, do not harm the hostage taker if he does not show any violence towards the hostages even if he is carrying deadly weapons. to define further, as long as the jostage taker does not harm the hostages and does not point/shoot their weapons at the hostages, they cannot and should not attack the hostage taker. maximum tolerance is deemed to be observed. now tell me guys, before the hostage taker saw his idiotic brother getting carried away by police, was he killing anyone? he was actually very cooperative and showed signs that he really did not want to kill anyone. try to read the postscript of the hostage survivor, then you'd understand what demeanor the hostage taker had before 7 pm. but what i am saying is not to defend the police, i actually want them to fiish their investigation and find out all that wnet wrong and correct them so as not to have the same thing happen again.
The police screwed up!
By the police's own admission, they became complacent after the hostage-taker released some of the hostages. This shows the lack of professionalism of the police force. The hostage situation should have been treated as life-threatening all the way until resolution.
At the onset, tasks should have been assigned - including researching the make of the bus and possible entry points. If they had done this they would have been aware of the TV inside the bus.
People died because the police failed. Excuses make it worse.

I totally disagree with Director Santiago.
Once a person declared a hostage taking and threatened to harm the hostage especially if that person is armed with a deadly weapon, he needs to be neutralize at the soonest possible time.
Negotiations should not be to appease the hostage taker and give in to his demand. If the authorities do that, then we are only encouraging disgruntled and crazy people to do the same thing. Negotiations are merely to give the authorities time to plan and act, time for the hostage taker to reconsider his actions and surrender to the authorities, and most important of all, negotiations are there mainly to give the authorities the right opportunity to neutralize the hostage taker when he least expected it.
There are opportunities where we can see the hostage taker can be neutralize. It is not about killing him but disabling him, disabling his capabilities to harm the hostages. This is the reason why we have SWAT team and tactical team especially they are only dealing with one person and at times, the hostage taker is open for their neutralization.
What have delayed their action is the presence of media especially that it is also being broadcast abroad. There are too many people who wanted to get involve, too many officers and politicians, too many who wanted to be the hero. In the end, it all backfired on them with 8 foreign national dead. Now, everyone involve in this hostage crisis are Pontius Pilate.
To Director Santiago, it is not unlawful to shoot hostage taker during talks if it means saving people lives. Remember, if the authorities gives in to his demand, then the authorities is encouraging for more.
