Erap maintains innocence in Dacer slay
MANILA - Former President Joseph Estrada has claimed that people who don't want him to run for president in May 2010 are dictating on former police officer Cezar Mancao about his alleged participation in the kidnapping and murder of publicist Salvador "Bubby" Dacer in 2000.
"It is unfortunate and injustice to the victims if the witnesses will allow their testimonies to be dictated by those who would not want President Erap to run for president in 2010," Estrada's spokeswoman, Margaux Salcedo, said in a text message to ABS-CBN News on Wednesday afternoon.
Estrada had said that there is now a bigger chance that he will run for president in 2010, citing his failure to unite the opposition and come up with a single presidential candidate.
Salcedo said Estrada "maintains his innocence" and added that Mancao's testimony, tagging the former president as the mastermind in Dacer's murder, is politically motivated.
Mancao told Judge Myra Garcia Fernandez of the Manila Regional Trial Court Branch 18 on Wednesday that it was Estrada, codenamed "bigote," who ordered policemen "to get rid" of Dacer.
He said the kill order was made after Dacer threatened to expose Estrada's alleged involvement in insider stock trading.
Mancao said it was Senator Panfilo "Ping" Lacson, former commander of the defunct Presidential Anti-Organized Crime Task Force, who relayed the kill order to former police superintendent Michael Ray Aquino, who is currently jailed in the United States due to an espionage case.
Another suspect in the November 2000 murder, former police superintendent Glenn Dumlao, appeared in the same hearing. He, however, was asked to stay out of the courtroom while Mancao delivered his testimony.
Reports said the court is considering dropping Mancao from the list of respondents and including him as an ordinary witness.
The judge scheduled the next hearing on September 3.

IF YOU REMEMBER, ECONOMIC INTELLIGENCE AND INVESTIGATION BUREAU (EIIB) WAS CLOSED DURING ERAP'S SHORT STINT IN THE GOVERNMENT, ALLEGEDLY FOR DUPLICATING THE FUNCTIONS OF THE BUREAU OF CUSTOMS. BUT THE TRUTH OF THE MATTER, IS THAT ERAP WAS SUSPICIOUS THAT HE CANNOT CONTROL EIIB PEOPLE BECAUSE OF HIS BELIEF THAT IT WAS STILL LOYAL AND WORKING FOR FORMER PRES. RAMOS SINCE EIIB WAS CREATED BY A TOP RAMOS' ADVISER.
HIS SUSPICION WAS REINFORCED BY THREE SMUGGLING ARRESTS MADE BY EIIB, NAMELY: THE SMUGGLING OF LUXURY CARS BY HIS SON, THE SMUGGLING OF LAP TOP COMMPUTERS BY HIS "ALLEGED" KUMPADRE, AND THE SEIZURE OF A BOAT CONTAINING SMUGGLED GOODS OWNED BY HIS MISTRESS WHICH ARE "ALLEGEDLY FOR CHRISTMAS GIFTS." THE LAST INCIDENT BLEW ERAP'S TOP AND PROMPTED HIM TO ABOLISH EIIB. ALL OF THESE CASES WERE KNOWN BY HIS FORMER FINANCE SEC. ESPIRITU (REVILLA'S IN-LAW, EIIB WAS UNDER THE DEPT. OF FINANCE) WHO EVENTUALLY VOLUNTEERED AS WITNESS AGAINST ERAP IN THE CELEBRATED IMPEACHMENT TRIAL. I AM NOT SURE IF LACSON KNEW OF CIRCUMSTANCES OF THESE CASES BUT IF HE DOES, HE SHOULD INCLUDE THIS IN HIS SUBSEQUENT EXPOSES.

If we question the timing of the Dacer-Corbito case, we might as well question the timing of NBN-ZTE case. The former involves Erap Estrada while the latter is linked to Gloria Arroyo. In the interest of fairness and fair play this should be our mentality, right? Yet, as for me, the law states that "an accused is presumed innocent until proven beyond reasonable doubt. That's why I'm reserving my criticisms when it comes to cases which are exclusively under the province of the judiciary.
HUWAG NATING ISIPIN NA NAKAKAPAGDUDUDA ANG "TIMING" NG PAGSAMPA NG ISANG KASO KASI ITO AY NAGDEDEPENDE SA PANGANGAILANGAN NG SAPAT NA EBIDENSYA AT TESTIGO. WALANG KINALALAMAN ANG PANAHON O ELEKSYON O ANUMANG DAHILAN MALIBAN SA PANGANGAILANGAN NG HUSGADO.
Finally, I don't believe that our justice system is controlled by the administration. Proof to this is that unlike the time of Marcos, the Supreme Court has proven during the administration of Arroyo, its impartiality by DECLARING MEASURES ALLEGEDLY BACKED BY MALACANANG, UNCONSTITUIONAL. To those cases, I pray that the people will let justice take it's course.
