No halt order on Napoles' arrest warrant

MANILA - The Court of Appeals (CA) has not yet issued an order stopping fugitive Janet Napoles’ warrant of arrest.

In a three-page resolution penned by Associate Justice Ramon Garcia, the appellate court’s Fourth Division held in abeyance the petition filed by Napoles through her lawyer Lorna Kapunan.

The petition aimed to quash the resolution of the Department of Justice finding probable cause against her and brother Reynald Lim in connection with the serious illegal detention case filed by Benhur Luy, the whistleblower in the P10-billion pork barrel scam.

The CA instead directed the respondents – the Makati court that issued the arrest warrant, the Department of Justice, National Bureau of Investigation, Luy and his family - to comment within a period of ten days.

Napoles was also ordered to file her reply within five days from receipt of the comments.

"Without necessarily giving due course to the petition for certiorari, the Office of the Solicitor General, as well as private respondents are directed to file comment within 10 days and to show cause therein why petitioner's application for the issuance of a TRO and/or writ of preliminary injunction should not be granted," the CA stated.

Associate Justices Amelita Tolentino and Danton Bueser concurred with Garcia.
