Napoles not yet convicted, reminds lawyer
MANILA - Lorna Kapunan, lawyer of controversial businesswoman and alleged pork scam mastermind Janet Lim-Napoles, on Friday reminded the public that her client has not yet been convicted of any crime.
In an ambush interview, she said the public must understand the difference, saying Napoles has been painted a "public enemy" even if charges have yet to be filed against her in court in connection with the pork barrel scam.
"She is not a convict. Ang stage pa lang nyan ay probable cause at pupunta pa sa korte yan para mag hearing. Baka akala ng publiko ay convicted na sya," she said.
Napoles is detained over charges of serious illegal detention filed against her by former employee and relative Benhur Luy.
Kapunan said her client has not been convicted of illegal detention charges.
"It is not as if she was found guilty of kidnapping. The first resolution of the fiscal, who is under the Department of Justice, sabi nya: 'There is no reason at all to charge Mrs. Napoles and the brother for the
serious illegal detention and kidnapping'. Sana naman wag gamitin ang kaso to keep her in prison," she said.
Kapunan also reminded the public that if allegations against Napoles are true, she could not have acted alone.
"Kung may criminal complaint for plunder, i-file na nila. This can be filed together with public officials concerned. Pag plunder ng public funds, di pwedeng private individuals lang yan. So may isasama yan for sure, na tatlo o apat o lima na senador. "
There are now three motions filed at the Makati Regional Trial Court branch 150
- motion to inhibit filed by Napoles lawyer (motion for Makati RTC judge lawyer who issued warrant of arrest to inhibit from case)
- urgent motion for voluntary inhibition filed by Atty. Carl Marlou Saranillo for Reynaldo Lim
- manifestation with urgent motion for reconsideration of commitment order dated August 29, 2013) filed by Janet Lim Napoles thru counsel.
