HK investigators urged to return hostage-taker's phone

MANILA, Philippines - The Incident Investigation and Review Committee (IIRC) on Monday urged Hong Kong authorities to return 3 cell phones used during the August 23 hostage crisis, including the one allegedly used by the hostage-taker, Rolando Mendoza. 

Justice Secretary Leila de Lima, who heads the committee, said a total of 8 cell phones were turned over to Hong Kong authorities after the hostage incident but only 5 belong to the victims of the tragedy.

A police negotiator, Chief Inspector Romeo Salvador, earlier said the cell phone of the hostage-taker was accidentally turned over to Hong Kong authorities.

He said a day after the incident, all personal effects of the hostages were given to the local homicide police. “They probably thought the cell phone belonged to 1 of the hostages,” he said.

The cell phone is relevant to the investigation as it would determine the calls made or coursed to hostage-taker Mendoza before he opened fire and killed some of the hostages. It was supposedly the cell phone used during Radyo Mo Nationwide's (RMN) fateful interview with Mendoza before he went on a rampage.

A total of 9 people, including Mendoza, were killed in the hostage incident last August 23.

De Lima, meanwhile, said the IIRC will extend its probe until Wednesday to obtain more testimonies from personalities linked to the August 23 hostage crisis. "As chair that is what I want. I am not bent on extending this further," she said.

The Malacanang-created panel earlier targeted 3 days to wrap up clarificatory hearings. The panel started its interviews last Friday.

Expected to appear on Tuesday are Radyo Mo Nationwide’s Michael Rogas, Erwin Tulfo and Jake Maderazo as well as GMA-7’s Susan Enriquez. The panel will also do an ocular inspection of the bus Tuesday.

She said Philippine National Police Scene of the Crime Operatives and other teams that investigated the crime scene and did autopsies on the remains of victims will present their findings before the committee on Wednesday.

"For the benefit of the public we asked them to prepare a power point presentation and tell us which bullet hit which victim, whose bullets these are," she said.

De Lima also refused to comment on criticisms leveled against IIRC co-chair, Secretary Jesse Robredo of the Department of the Interior and Local Government. Various groups said Robredo should have inhibited from the investigation since his department could be held liable for the hostage tragedy.

"I choose not to comment on that. We will not be sidetracked by those side issues and we are bent on finishing the job," she said.

The head of the country's police forces, Director General Jesus Versoza, on Sunday meanwhile said he took full responsibility for his men's failures as he announced an early retirement.

Five police officers who led the botched rescue had already been suspended in the political fall-out after the crisis.

"More than ever, it is imperative to take responsibility especially with regards to what has transpired in the past week," Versoza said in a statement.

Versoza said he was also accountable for all police officers "in everything they do and failed to do." He had told the inquiry earlier that he left town at the height of the crisis on an official business.

As I recall, following the incident of the PNP Police Officers in Cash Scandal (Russia) involving a retired official headed by Eliseo dela Paz & 3 other active senior officers for the unauthorized release of P6.9 million in cash advance for an official mission abroad. Wherefore you, as the PNP Chief Director (Jesus Versoza), ordered the filing of criminal charges against former police comptroller Eliseo dela Paz who was held at the Moscow airport for not declaring such amount that he was carrying.

In fact at a press conference in Camp Crame, you said that you have directed the CIDG to coordinate with the BOC at NAIA to investigate the non-declaration of such cash amount Eliseo dela Paz brought outside the country. You further said that such charges will also be pursued against him and 3 other ranking police officers for the unauthorized release of the funds. PNP declared that the authorized cash advance for Dela Paz and 7 other delegates to the 77th Interpol General Assembly in Moscow, Russia is only P2.1 million but it wasn’t known why they were able to release the total amount of P7 million (i.e. unauthorized) out from the PNP funds.

Following such PNP Senior Police Officers’ Cash Scandal, GMA issued an Administrative Order No. 103 for the Suspension of all travels except for ministerial meetings, scholarships and trainings that are grant-funded or undertaken at no cost to the government. However, you boarded a plane to Singapore along with 7 of your personnel. I just happened to be at the same plane which you were in until Singapore airport and you were wearing then a polo shirt bearing “Dir. Gen. Jesus Versoza & Team”.

Now then, many have been confused why the PNP didn’t have such equipment needed for such hostage-taking incident.

1. Are those alleged funds been released undocumented and
unauthorized from PNP funds under your watch?
2. Did you approve it then?
3. Has such unauthorized release of P6.9 million taken by Eliseo
dela Paz and 7 other active senior officers been resolved?
4. Is this P6.9 million intended for the so-called SWAT funds?
5. Was that travel to Singapore paid by the government despite
GMA’s Administrative Order 103; Section-1; Para.-1?

Administrative Order No. 103: Section-1, Paragraph-1:

“Suspension of all foreign travels, except for ministerial meetings, and scholarship/trainings that are grant-funded or undertaken at no cost to the government.
Henceforth, all foreign travels of Presidential appointees, even if allowed under this provision, must first be cleared by the Office of the President. Further, all agencies shall submit a monthly report to the Office of the President, stating the names of officials or employees who traveled abroad, the reasons for such travel, and the cost incurred by the government.”

Director General Jesus Versoza, are the following cases against Eliseo dela Paz and other 7 Active Senior Police Officers finished and done with? Have they been given appropriate penalties?

The Senate Foreign Relations Committee during the investigation drafted reports citing the following offenses that the PNP delegation to the 77th Interpol General Assembly in Moscow, Russia might be accounted for:

- Malversation (Article 17 of the Penal code)
- Technical malversation of public funds (Article 220)
- Violations of the Anti-Graft and Corrupt Practices Act
- Violations of the Anti-Money Laundering Act of 2001
- Violations of the New Central Bank Act
- Travel ban (Administrative Order No. 103 issued by GMA)
- Travel ban on account of austerity measures (Executive
Order 459 and PNP Circular No. 202-017 of 2002)
- Law on allowable travel expenses (EO 298)
- Law against travel of officials about to retire

PNoy, what is going on? These didn’t take place during this administration but surely you can make an inquisition(s)!

Do not allow this PNP director general to rest without resolving all those issues pending at hand!
