Rebellion charges to be filed vs 7 Ampatuans, 17 others

MANILA, Philippines - Rebellion charges are set to be filed in court against 24 individuals, including former Maguindanao Gov. Andal Ampatuan Sr. and Autonomous Region in Muslim Mindanao (ARMM) Gov. Zaldy Ampatuan, the Department of Justice (DOJ) said Tuesday.

The charges will be filed before the Cotabato City Regional Trial Court on Wednesday, the DOJ said.

Aside from Ampatuan Sr. and Zaldy, the DOJ will also file rebellion charges against Akmad Tato Ampatuan, Anwar Ampatuan, Sajid Islam Ampatuan, Goldo Ampatuan, Abdulla Kaliangat Ampatuan, Kusain Akmad Sakilan, Jovel Vista Lopez, Rommy Gimba Mamay, Sammy Duyo Villanueva, Ibrahim Tukya Abdulkadir, Samil Manalao Mindo, Amaikugao Obab Dalgan, Billy Cabaya Gabriel Jr, Moneb Smair Ibrahim, Umpa Ugka Yarya, Manding Abdulkadir, Dekay Idra Ulama, Kapid Gabriel Cabay, Koka Bating Managilid, Sammy Ganda Macabuat, Duca Lendungan Amban and Akmad Abdulijah Ulilisen.

DOJ Undersecretary Ricardo Blancaflor said that the panel of prosecutors investigating the November 23 massacre has wrapped up its inquest proceedings against the Ampatuans and their co-accused.

However, due to a provincial holiday declared Tuesday celebrating the Catholic Feast Day of the Immaculate Conception, the DOJ was not able to file the case in court, Chief State Prosecutor Jovencito Zuño said.

Based on the findings of prosecutors, Blancaflor said there was probable cause to indict the 24 for rebellion.

He said the case will be filed based on the affidavits submitted by the witnesses accusing the Ampatuans of ordering government offices to close down in protest of the crackdown of the military against the family.

Other witnesses also testified on the role of the Ampatuans in planning and implementing the withdrawal of allegiance from the government.

Meanwhile, Blancaflor said the prosecutors will amend the 25 counts of multiple murder charges filed against Datu Unsay Mayor Andal Ampatuan Jr., saying that 15 more counts of multiple murder will be added.

Ampatuan Jr. is the prime suspect in the November 23 incident, which left 57 people dead.

However, Blancaflor said they might wait for the formal transfer of the case to the Regional Trial Court of Quezon City before filing the additional charges.

The Supreme Court on Tuesday approved the transfer of the murder case of Andal Jr. and other co-accused from Cotabato City to Quezon City.

'Separate rebellion, murder charges'

Meanwhile, constitutional law expert and Ateneo Law School dean emeritus Fr. Joaquin Bernas said that the government has a big job ahead in proving that the murder cases against Ampatuan Jr. are not connected to the alleged rebellion in Maguindanao.

Bernas said that if the Maguindanao massacre cases become connected to the rebellion charges, which was the basis for the declaration of martial law in parts of the province, the murder case will be absorbed by the heavier rebellion case.

If this happens, Bernas said, even if Ampatuan Jr. becomes convicted of murder, since it is already part of a rebellion case, the President can grant him pardon after the final conviction, and he can also be granted amnesty.

However, amnesty could be harder to come by, since it requires approval of Congress, voting separately.

Because of this possibility, he urged the public to be more vigilant to help bring justice to the victims of the massacre.

'Ampatuan Sr's arrest still justifiable'

Meanwhile, University of the East (UE) College of Law Dean Amado Valdez said that the government's detention of Ampatuan Sr. is still justifiable.

In a phone interview with ABS-CBN News, Valdez said the law states that the government can still file a case versus the former Maguindanao governor on Wednesday, since Tuesday is a holiday and is not counted in the 72-hour window.

Valdez said what's important is that the case is filed on the first working day after the holiday to avoid having a delay of delivery of a detained person in court after a warrantless arrest.

He added that the law states that the case should be filed within 72 hours. He said that it is insufficient to just start the inquest proceedings, adding that this should have been completed because the three-day allotment is already sufficient to gather evidence against an accused. Rebellion

Paano nga kung mag-plead ng guilty ang mga Ampatuans at yung ibang mga nakasuhan sa rebelyon at sasabihin nila na ang masaker ay paghahanda in pursuit of rebelyon. Aaminin na nila na rebelyon lang talaga ang dahilan ng pag-masaker. Paano ngayon idi-dispute ng korte ang guilty plea sa rebelyon case which covers murder? Gagamitin din nila yung mga ebidensya na nakuhang mga armas paghahanda sa pagsalakay sa gobyerno.

Never been in Maguindanao

I understand people who are against the declaration of Martial Law in Maguindanao Province. For sure, they have never been in that province. But i'm also sure that they will change their minds the moment they have spent a single moment of their lives in Maguindanao. Sometimes theory is far cry from reality....

that's it.. martial law pala kontrolado ang imbistigasyon.. pwedeng pagbawalan ang mga media. baka merong mga past election-cheating related evidences na ayaw pakita baka mabuking. yan na nga meron na raw nakita na maraming voters' IDs sa isang sako. hmmm.. smells fishy talaga. baka preparation sa coming election. naglalabasan na ang mga baho...

Wag muna pag-usapan ang sinabi ng CHR na 200 kase kailangan pa ng maraming evidence at imbestigasyon. Nakowwwww, baka mauwi lang sa "sorry" ang murder case na yan... ibang klase talaga. sana naman wag mangyari. Sana naiisip ng mga may powers na "God is watching you"... You can run but can't hide.

Okay sana ang martial law

Okay nga sana ang Martial Law. Malilipol lahat ang mga walang kaluluwang mamamatay-tao sa Maguindanao. Pwedeng ibalik ng Martial Law ang katahimikan sa Maguindanao. Pero malaki ang problema: si Gloria Arroyo at ang kanyang mga galamay. Para sa isang pamunuan na mahigit kalahati ng mga Pinoy ay hindi nagtitiwala, mahirap payagan na dadagdagan pa ng batas militar ang kanyang kapangyarihan. Matagal ng niloloko ni Arroyo ang mga Pilipino. Baka puro na naman panloloko ang deklarasyon ng Martial Law para makalusot siya sa malaking problema sa mga Ampatuan.

Wow! that was a good input riosil i truly agree with you. what i dont untersdant so many people still confuse the process of Martial law. just simple as it is, quick and easy way to solve the issue period. i do vote for martial law just because who do we trust if the leaders itself commet the crime. What is wrong with the ampatuan family there crying in the media like they are the victem, come on you still have tears to shade, what happen to the 57 innocent people who cant even say goodby to thier family. what happen to thier kids that would never see thier father/mother forever.


Tactics

Since we all know that the Ampatuans are strong allies of PGMA,i think everything that is happening in Maguindanao are part of the president's tactics. She is trying to cover the election fraud in the 2004 and 2007 election and as well as save the Ampatuans in the end.

We should be vigilant in every event and move of the government for our freedom is at stake.

Other Senators and other groups opposing the implementation of martial law in maguindanao because we can not deny the fact that these said senators and groups were benefited to the fabricated votes produces by ampatuans clan thats why they won the senatorial seats..Infact this should be their responsibility to suggest the best way on how to destroyed private armies loyal to ampatuans clan and not just keep on criticizing the malacanang strategies to arrest those involve in the massacre...Concern officials already explained that the purpose of temporary martial law in Maguindanao is to fast tract and destroy private armies as well as speed up bringing justice to the victims.. Urgency is there...what can you say to those people loyal to amptuans involve in the massacre who are battling and refuse to surrender their weapons the PNP/militaries? Is that not a case of rebellion? Are the discoveries of high powered weapons and ammos among those ampatuans not a threat to the philippines/filipino people? How many victims of corrupt officials you want to be sacrifice? Most opposing senators and groups are taking advantage on this issue to endorse thereselves for their own personal purpose..What can you say those victims of massacre?..Poor Philippines due to crab mentality and corrupt officials..Free those Magdalo group who publicized the corrupt activity of high ranking AFP officers because some evidences of their allegations already dug-up. We insist martial law to those private armies specially those involve in the massacre...No to TRO on martial law, let all private armies be destroyed by martial law and bring justice to the victims..
