Failon to face QC prosecutor's office next week

The lawyer of ABS-CBN news anchor Ted Failon on Friday afternoon assured that his client will cooperate with the preliminary investigation regarding the obstruction of justice charged by the Quezon City police.

"We're not really concerned about the subpoena because we really intend to participate in the preliminary investigation by the Quezon City Prosecutor's Office," Failon's lawyer, Alfred Molo, told ABS-CBN News Channel's Top Story.

Molo said Failon had already agreed to appear before the prosecutor's office on Tuesday at 2 p.m.

He said they are now preparing a counter affidavit to the obstruction of justice complaint. He said the other members of Failon's household who have been accused by the Quezon City police of obstruction of justice will also be preparing their counter affidavits.

Also on Friday, city prosecutor Jane Pamitan ordered the release of Pamela Arteche-Trincheta and Carlota Morbos, Failon's household help for 12 years, for lack of evidence that would prove the police's obstruction of justice charges against them.

At 5 p.m., Quezon City court Judge Ofelia Arellano-Marquez's release order for Failon's driver, Glenn Polan and household helpers Pacifico Apacible and Wilfredo Bollicer arrived at the Quezon City police's detention facility, where the three were held for almost 20 hours since Thursday night.

The three posted P12,000 bail each.

Police accused Failon's group of obstruction of justice for cleaning the blood at the bathroom, where the news anchor's wife, Trinidad Arteche-Etong, was found Wednesday morning.

Househelpers Apacible and Bollicer also cleaned the trail of blood on the floor of Failon's home in Tierra Pura Subdivision in Quezon City.

Apacible had admitted in a sworn statement that he was the one who took the gun used in the alleged suicide.

He said that from the bathroom, he brought the gun back to its hiding place inside the master's bedroom.
