The Supreme Court (SC) has denied with finality the Motion for Reconsideration filed on the Bai Sema vs Commission on Elections (Comelec) case on the division of Maguindanao and formation of Shariff Kabunsuan provinces.
This means the creation of the province of Shariff Kabunsuan is considered nullified.
In its resolution, the SC said they found no compelling reason nor substantial argument to warrant the reversal of the questioned decision.
The SC earlier junked the creation of Shariff Kabunsuan on the grounds that it was only the Autonomous Region on Muslim Mindanao that created it, and not Congress.
The Court maintains it is only Congress who can pass laws on the creation of a new province.
