Mistaken identity destroys OFW’s dreams

MANILA, Philippines – Jason Aguilar hogged headlines upon his return to Manila from Doha, Qatar.

But it was not a hero’s welcome that greeted him at the Ninoy Aquino International Airport (NAIA). He came home with unfulfilled dreams for himself and his family and with a terrible experience that scarred him.

“At kung hindi dahil sa pagkakamali, dapat ang mga pangarap ko sana makukuha ko,” Aguilar said.

Aguilar’s parents pin their hopes on their youngest child.

"Hanggang ngayon, hindi pa namin nababayaran yung mga inutang, ginastos. Minsan luluwas iyan ala pang pamasahe, hahanap pa,” said his mother Lilian.

Aguilar was detained by the Doha police after he was mistakenly identified as American citizen Jason Ivler, the road rage suspect wanted in the Philippines.

Ivler’s mother, Marlene Aguilar, is the sister of famous singer-composer, Freddie Aguilar.

For 7 days following his detention a few hours before New Year’s Eve, Aguilar said all he could do was to think about what he had done wrong to be in that predicament.

“Takot na takot ako nun,” Aguilar said.

Aguilar's ordeal

Atom Araullo of ABS-CBN News interviewed Aguilar in his hometown in Calumpit, Bulacan. There, the OFW recounted his ordeal, the experience that scarred him and the uncertainty of his and his family’s future.

“Lagi akong lakad ng lakad sa kulungan. Iniisip ko kung anong kasalanan ko tapos lagi akong kinakabahan tuwing may darating na pulis kasi nga hindi ko alam kung anong gagawin sa akin,” he said.

Aguilar left for Doha on the morning of November 18, or several hours before the tragic shooting of Renato Victor Ebarle Jr. Ivler is accused of shooting Ebarle Jr., the son of Palace official, Renato Ebarle Sr.

In a phone conversation, Ebarle Sr. offered apologies to Aguilar for what he has gone through, which the OFW accepted.

“Masasabi natin sorry na lang sa mga pangyayari pero andyan kami tutulong sa iyo,” Ebarle Sr. said.

A representative from the Overseas Workers Welfare Administration (OWWA) also visited Aguilar and promised to help him get his job back.

DFA asked to explain

Meanwhile, the Blas F. Ople Policy Center on Friday demanded an explanation from the Philippine post assigned in Qatar on why it failed to provide the much-needed assistance to the OFW.

The Ople Center also sent a letter to the Department of Foreign Affairs to look into the “lack of legal representation” accorded to Aguilar while detained in Doha.

"Jason was thrown in jail for 7 days and deported out of the country for a crime that he had no part in, and was not even aware about. Throughout this harrowing ordeal, not once did Jason see or hear anyone from our embassy. This is a clear case of negligence and our embassy must explain why it failed to help Jason clear his name while he was under detention," said Ople Center head and senatorial bet, Susan Ople.

Ople cited that under the Migrant Workers’ Act, all distressed OFWs are entitled to legal and other forms of assistance from the Philippine embassy.

She added that the Ople Center will also write formally to the National Bureau of Investigation (NBI) and the Bureau of Immigration on Aguilar's behalf, to ask that his record be cleaned and expunged of any association with the road rage suspect.

Likewise, the Center will also ask the Philippine Overseas Employment Administration to look into the recruitment process in connection with a US$500 placement fee charged by Jason's recruiter.

"This is over and above his anticipated monthly salary in Qatar. Baon na sa utang bago pa umalis, napagkamalan na killer habang namamasukan na welder sa Qatar, pinauwi ng ni hindi natulungan ng embahada para malinis ang pangalan -- ang nangyari kay Jason Aguilar ay hindi na dapat maulit pa sa kahit sinong OFW," Ople said.

Garry Martinez, chairperson of Migrante International also demanded an apology from Qatari and Philippine officials for the trouble they have caused Aguilar.
 
“At the very least, Qatari and Philippine authorities should issue an apology to Jason Aguilar and his family for this serious case of mistaken identity. This blunder has already cost the poor OFW his job, leaving his family who depends on his earnings, with a bleak start in the New Year,” Martinez said. Reports from dzMM and TV Patrol World

Wag na po sanang paabutin ng gobyerno natin na sa kulungan na lamang matatagpuan ang kaawa-awang OFW dahil nakapatay na ito o nakasakit ng Indyano, Pakistani, Arabo, o ano pa mang lahi dahil sa kawalan ng mahihingang tulong habang nasa abroad. Isa po sana sa mga activities nila ang reach-out programs sa OFWs, na sila ay parating nakasuporta sakaling magka-problema ang OFWs sa abroad. Wag po sana nilang sabihin lang ito, gawin po nila lahat ng magagawa nila para tulungan ang mga OFWs. Mahigpit po talaga ang mga batas sa Middle East.


Nababasa ba ito ng ating mga officials?

Ang POLO-OWWA offices po natin na nagkalat sa iba't ibang panig ng mundo ay may mga lawyers, PRO, at iba pang mga itinalagang suporta sakaling magkaproblema ang mga OFW's, na tinatawag nyong "bagong bayani ng bayan". Bakit naman po di makakilos ang ating mga officials sa para ipagtanggol ang mga naaaping OFWs sa abroad? Napakarami rin pong labor violations sa hanay ng mga suwail na foreign employers. Paki-check nyo po ang kalagayan ng mga pinoy workers, meron po kayong rehistro ng mga OFWs sa inyong nasasakupan.

The facts are there:
• Aguilar was arrested 31 December 2009.
• Aguilar was able to convey to his relatives in the Philippines that he was in jail by borrowing a mobile phone from a fellow inmate.
• DFA inquired to the Philippines post in Qatar last 06 January about the arrest of a Filipino.

To the Philippines post in Qatar:

• Qatar authorities in general would not inform foreigners’ arrest unless a country has a bilateral consular agreement – “Phillipiine ambasssador”.

Really, so what are you doing there? Why don’t you secure one / or prod the Senate to ratify / or seek an agreement with the Qatar government.

• Consul Jabar Adiong instructed his staff to inquire from immigration authorities but got negative replies.

I am sorry, but please don’t give me that BS.

Statements from the Ambassador:

“in general, [Qatar] they would not inform the country of that national about the arrest except if the country has a bilateral consular agreement”.

“….embassy will immediately send a note on why authorities in Qatar did not inform the post about Aguilar”

There seems to be a contradiction between the first and your next statement Ambassador.

This is a plain and simple

This is a plain and simple manifestation of philippine embassy pathetic, negligence, unconscionable, unreliable omission of responsibility. The staff of the embassy are only quick when it comes to imposing collection of money from OFW. This labelling the OFW as HEROES, my ass, is without meaning and substance. OWWA is very deligent when it comes to collecting 25$ from every OFW returning or dispatched to work overseas but when it comes to helping the OFW they are hopeless. The case of Jason Aguilar is indisputable, a solid mark of inefficiency, without regard to the welfare of OFW. People of the Philippines, put this in your mind and heart during this coming May 10, 2010 election to elect the candidates that are sincere and committed to the welfare, not only of OFW's but of all the neglected citizens and those who has less in life in this country. What would you expect with this rotten government that has no self discipline and decency hence cannot discipline these erring embassy staff involved in this negligence.

Maraming ganitong klase ng pagmamalabis sa mga OFWs at kadalasan ay sa Middle Eastern countries. Sana lang may kakayanan ang ating POLO-OWWA officials na makipag-areglo sa mga employers at government officials kung saan naka-base ang OFW. Wag sana silang tikom lamang ang bibig. Talaga namang nakasisindak ang policy ng Arab nations sa mga expats kaya siguro nag-iingat din ang Philippine officials.

Ako rin ay biktima ng pagmamalabis mula sa isang Indian-managed firm sa Dubai. Wala ring nagawa ang POLO-OWWA sa Dubai, bagkus pinaghain pa ako ng reklamo sa POEA-Manila. Doon na lang ako nag-file ng kaso laban sa agency ko at foreign employer. Kasalukuyan pang dinidinig ang labor case ko sa Pilipinas. Dalawang kaso ito, POEA case at DOLE-NLRC case, na nai-file mula pa noong April 2009. Nag-aantay pa rin ako ng decision hanggang ngayon.

Ito ay isa na naman na katibayan na ang ating mga embahada sa ibang bansa ay walang ginagawa kundi ang magpasarap at magpasasa sa sweldo na nakatunganga lang. Magbago nn kayo gawin nyo nman ang trabaho nyo kung bakit kayo nandidiyan.
