MANILA, Philippines – The Commission on Human Rights (CHR) will conduct an investigation into the death of a suspect while in the custody of the Manila Police District (MPD).
Nestor Delizalde Jr. was arrested for the killing of Banco de Oro executive Evelyn Tan, her mother Teresa and their household helper Cristina Bartolay in their house in Sta. Cruz, Manila last November 11.
He was shot dead after allegedly trying to grab the gun of one of his police escorts.
“Ang dalas-dalas na niyan sa Maynila kaya naghihinala na ako na sobrang napakahina...kasi kung totoo ‘yan na nangaagaw ng baril itong mga suspects eh nangangahulugan lang na napaka-incompetent ng ating mga kapulisan,” CHR Chief Etta Rosales said.
Rosales said gun-grabbing incidents where suspects end up dead, seemed to be happening only in Manila.
“Bakit dito lang sa Maynila nangyayari yan? Kaya naghihinala na ako na either kulang na kulang talaga ang training sa kanila or its an unwritten policy na pinababayaan na lamang in which case talagang masasabi kong gross violation of human rights ito,” she said.
She added that such incidents taint the name and reputation of the police force.
The CHR chair also criticized the MPD for failing to protect the rights of the accused.
“Hindi nila tinitiyak na may protection ang rights of the accused,” she said.
For his part, MPD Deputy Director Senior Superintendent Robert Po said an investigation is also being conducted regarding the incident.
“Itong huling insidente ng panga-agaw ng baril, ito po ay pina-iimbistigahan na namin,” Po said.
They are likewise determining if Delizalde’s police escorts were the same group who were involved in a similar incident in the past.
“If they are the same policemen, there's something wrong with it. Pero kung iba’t-ibang pulis naman at laging naaagawan itong galing sa isang unit, amin pong titingnan kung kinakailangang sila ay magsanay or mag-undergo ng further training on firearms handling,” he said.
Po said police escorts will be slapped with an administrative case for negligence.
“Kung may complaint sa mga kamaganak ng namatay pinapatawan naman namin ng homicide and its up to them to justify their action before the court,” he explained.
