MANILA, Philippines - Former First Gentleman Jose Miguel Arroyo has reiterated his move to have the Office of the Ombudsman drop the graft and corruption case against him for the allegedly anomalous sale of choppers to the Philippine National Police (PNP).

In a reply to the prosecution's "verified manifestation and compliance," Arroyo asked the Ombudsman "that the resolution, dated 30 May 2012, be reconsidered, reversed and set aside" and that the charge against him for violation of Section 3(e) of Republic Act 3019 be dismissed for lack of probable cause.

Arroyo insisted he was implicated on the basis only of speculative conclusions that he is the owner of the helicopters and that he had a hand in the transaction between Manila Aerospace Products Trading (MAPTRA) and the PNP.

He said he did not own the choppers at the time of the transaction.

"Various documentary evidence, including sworn statements attached to respondent's counter-affidavit and rejoinder, show that the helicopters sold to the PNP were imported by Mr. Po and registered in the name of Mr. Po's Asian Spirit and Lionair," his reply said.

Arroyo also maintained he had no participation in the negotiation.

In his pleading, Arroyo also said the prosecution did not respond to his earlier motion for reconsideration since the issues he raised were already allegedly addressed in the investigating panel's joint resolution dated May 30, 2012 "even if it contains the documentary evidence found to be absent in the panel's joint resolution."
