SEPANG, Malaysia – Toyota on Wednesday abandoned its appeal over Jarno Trulli's penalty at the Australian Grand Prix that saw him relegated from third to 12th.

The Italian was slapped with a 25-second penalty for overtaking during a safety car period, elevating McLaren's Lewis Hamilton onto the podium.

Toyota protested the stewards' decision but its initial attempt was rejected because drive-through penalties cannot be appealed.

The team took the matter to the Australian Grand Prix's clerk of the course but has now decided not to pursue it further, meaning world champion Hamilton keeps the six points he earned for third place.

"Having considered recent judgments of the International Court of Appeal and referring to the Sporting Code, it is believed that any appeal will be rejected on a procedural point..." Toyota said in a statement.

"Based on this, Toyota Motorsport has decided that it would serve no benefit to pursue this course of action."
