Faustino: SC justices should have decided on ownership issue of San Miguel shares first

In the second segment of Business Nightly’s October 14 chat with Coconut Industry Reform executive director Joey Faustino, issues discussed included the sequestration of the disputed shares in San Miguel and an interpretation of votes of the individual Supreme Court justices who took part.
Faustino noted the Supreme Court chief justice Reynato Puno, who is close to the lawyers of San Miguel chair Eduardo Cojuangco, has always voted against coconut levy as public funds. This goes against Puno’s Moral Force movement, the farmers group representative told host Ricky Carandang.
He also cited Justice Antonio Eduardo Nachura, who used to be with the Office of the Solicitor General (OSG), essentially the lawyer for the Presidential Commission on Good Government, which is the agency in charge of preserving sequestered assets. Faustino said the OSG has taken the position that the contested shares in San Miguel are public funds.
Faustino said he was surprised why Nachura voted to allow the conversion of the San Miguel shares to non-voting preferred shares, instead of deciding first who owns the contested shares.
