Tupas clueless on who will sit in JBC

MANILA, Philippines – Iloilo Rep. Niel Tupas Jr. admitted Monday he is clueless on who will sit in the Judicial and Bar Council after the Supreme Court ruled that Congress can only send one representative to the council.

Tupas, who represents the Lower House in the JBC, said he will file a motion for reconsideration before the SC since its decision does not reflect the bicameral nature of Congress.

“For us, the decision is really absurd because the Senate cannot represent the House of Representatives and the House cannot represent the Senate,” he said.

The lawmaker said 4 of the regular members of the JBC are appointed by the President while the fifth is supposed to represent the executive branch. The 6th member is the Chief Justice, who is expected to sit as chairman, while the 7th comes from Congress.

Tupas said the constitutional provision on the JBC is flawed since it only considered a unicameral Congress.

“The bicameral nature of Congress fiscalizes JBC…If you remove or curtail that, babalik na naman sa dati. Secret society kasi yan. Ang SC by nature parang secretive. Hindi sila transparent. JBC is under it supervision, hindi alam ng tao nangyayari diyan ngayon lang talaga nung nabuksan yung impeachment,” he said.
